Well if thats the case you still have almost a 1 1/2 left before you could rely on the SOL....not till Nov 2013.

If you think you are in a position to make somekind of payment arrangement with them...give it a shot...if not wait and see if they follow through with their threat...and it will still take about a year to go through the system.

So I called MBNA and found out that Nov, 2011 was the last time I made a payment with amount $300.00
I read other post and do I need to write a letter to them?

It is not unheard of that an agency threatens to sue just to intimidate, and then later down the road knowing the SOL has expired , launch a action and not tell you. If you do get notice yes you would need to go to court and put forth the defence that the SOL has expired on this account if infact it has been more then 2 years since you made a payment or acknowledged the debt in writing as Daniel has said.

A default judgment is not going to happen in this case since they've already threatened you with court action. They wouldn't do that if they were going for a default judgment.

Like I said, find out the date of your last payment AND keep your correspondence to the telephone. At this stage, you need to see if they're bluffing.

TJ, could you explain this in more detail?
So does this mean I have to go to a court? Are they going to send me the court date?

A common ploy by collection agencies is to sue you and not serve you notice....then when you do not show in court they obtain a default judgement. These can be reversed but requires alot of running around on your part. In 3-6 mths get an update on your report to see if a judgement has been registered.

That would be a real good idea. Remember that, just as with the previous blogger, the collection agency has to send you their complete file - should you need it.

Nevertheless, since MBNA was the original creditor, they'll probably give you the information if you call. Surely, you must have some idea though when you made the last payment. If it was more than 2 years ago, you don't have to worry about them getting a judgment.

I could find out when the last payment was made tomorrow.
Also I don't think I signed anything sent by MBNA.

If your file was sold to the collection agency....they do not need a letter of authority from MBNA to commence an action.
Sounds like an intimidation ploy to me. But do answer Daniels question as it will give us the info to advise you better as to your next move.

When was the date of last payment on the account. Have you provided any signed written acknowledgement since?
