The next time that you are talking to a collector at CRS, tell them to "cease and desist" all further telephone calls and that any future communication with you shall be by mail only sent to your residence. Immediately follow up this telephone call with a letter confirming your request and send it by registered mail. Be sure to keep a copy for your records.

Continue to make your payments as you are now doing. As long as you are making your monthly payments, they won't bother you. In the off-chance that they send you a letter demanding a lump sum payment or threatening or harrassing you, file it under "G" ( garbage ). No creditor or collection agency will sue you as long as you continue to make your payments. They want all the money upfront, but they can't always get what they want.

HI THERE

IN OCT 2010 I BEGAN RECIEVING CALLS FROM CONTACT RESOURES FOR A CANTIRE ACCOUNT OF $2691. SINCE THEN THEY HAVE BEEN CALLING MY HOUSE EVERYDAY. I HAVE MADE PAYMENTS BUT THEY KEEP THREATENING TO TAKE ME TO COURT AND I WOULD HAVE TO PAY $6000 IN LEGAL FEES.

CAN THEY REALLY DO THIS?
I HAVE TOLD THEM THAT I CAN MAKE MONTHLY PAYMENTS OF 150. A MONTH BUT SHE SAYS THATS NOT GOOD ENOUGH !
SINCE THEN IVE PAID THEM OVER $300

I REQUESTED A COPY OF MY CREDIT REPORT FROM TRANSUNION AND THERE IS NOTHING INDICATING THAT THIS ACCOUNT WAS INDEFAULT.

IM SOO CONFUSED

DO I HAVE TO PREPARE TO GO TO COURT FOR THIS MATTER?

Thanks again for the info footloose, your proving to be a fount of knowledge.

Ill keep an eye on my credit reports with both agencies, just incase they somehow manage to get it on there again. As well the Cease and Desist I may or may not try, depending on how they decide to handle the circumstances.

Under the Ontario Consumer Reporting Act, no credit reporting agency ( i.e. credit bureau ) is permitted to list a "Tradeline" with negative information that extends beyond 7 years. Equifax's POLICY is to purge all "Tradelines" after 6 years that contain either positive or negative information. TransUnion's POLICY is to purge all "Tradelines" that contain negative information after 6 years. All "Tradelines" that contain positive information only are listed for 20 years.

Under the Ontario Collection Agencies Act, if you send a "cease and desist" letter to a collection agency, they are required to cease contacting you by telephone but they can still contact you by mail.

PLEASE NOTE The "cease and desist" letter only applies to collection agencies who are registered under the Ontario Collection Agencies Act. This letter has no application to original creditors and debt buyers.

Thanks for the info/advice footloose.

Something i remembered from a previous call was that they threatened to put the listing back on my credit report. I havent gotten a copy yet but i was wondering if they are even allowed to repost a debt dating back this many years.

As well if i were to go the route of a cease and desist who does that limit them to contacting?

In Ontario, the SOL for any debt that went into default after January 1, 2004 is 2 years. For any debt that went into default prior to January 1, 2004, the SOL is 6 years. If this debt went into default 9-10 years ago, it clearly is statute-barred. This means that the creditor, collection agency or debt buyer cannot enforce the collection of this debt by taking legal action and commence a lawsuit against you. You must understand, that once a SOL expires it CANNOT be resurrected or reinstated.

If a payment is made or a WRITTEN acknowledgment of the debt is made and SIGNED by you, and this is done at anytime WITHIN the SOL period, this will EXTEND the SOL only. For example, if you defaulted on a debt in Ontario on June 30, 2008, the SOL expires on June 30, 2010. If no payment is made or written acknowledgment of the debt and signed by you is made within this period, then no legal proceeding can be commenced against you after June 30, 2010. However, if you paid only $1 or made a written acknowledgment of the debt and signed by you on June 28, 2010, this now extends the SOL to June 28, 2012.

I strongly suggest that you obtain credit reports from both Equifax and TransUnion to see where you stand. You can download both credit reports from their respective websites for a fee. If you do not want to pay a fee, you can request a consumer disclosure report for free by completing the request form and mailing this form to the respective credit bureaus. The form can be downloaded from each website. The consumer disclosure statement will arrive by mail in 3-4 weeks.

If you want to settle this debt, offer them 25% and tell them to "take it or leave it". If they refuse the offer, tell them that you will pay them nothing. This debt is 9-10 years old and most collection agencies will settle for this amount. Stand your ground and be firm. If they refuse, come back and let us know what they will accept. I will tell you what next steps to take. If they accept your offer, DO NOT PAY them a cent until you come back to this website and tell us about the offer. Otherwise, you may fall into a trap. I will explain later.

Ive recently been contacted by CRS regarding an old debt dating back 9-10 yrs (this is the last time any action was taken on the account according to them).

The balance owing has almost tripled because of interest to over $3000 and im trying to get some help/info on how i can deal with this whole situation.

I had a credit check done almost 2 years ago and nothing showed at that time, I was even able to get another credit card from the company this debt originally started with.

I spoke with CRS on the phone and dont recall whether i admitted ownership of this debt. Would this make a difference regarding what actions i can take?

I requested All paperwork regarding the account for verification as the letter they sent said i was allowed to do, and when i did so they explained i would not be able to settle for a lesser amount of 1k'ish if they had to provide this paperwork (apparently this is company policy) i would have to pay the full amount of over 3k.

From what they told me the account was bought by them in either 04 or 06 i dont recall but if im not mistaken wouldnt this still put them outside the Statute of Limitations for Ontario? (Would this be affected by my admitting on the phone it was my debt if that is in fact what i did?)

Im hoping ive provided enough info for at least a couple suggestions, if any more info is needed i would be happy to add it, and if i think of anything else i will add it as im able.
