I have worked in the collection field and if you have provide them the bankruptcy documents and it shows the account they are trying to collect on in the bankruptcy than they can no longer continue to call you.

With regards to making a complaint against the agency it would depend on what province you live in. In BC it is the BPCPA or google Consumer Protection Act and they should have forms you can fill out online. You can advise them they are trying to collect a debt that was included in your bankruptcy and have put it on your credit bureau and you would like it removed..

With regards to the second account advise them not to contact you unless they can prove you have this account. By saying they never sent you a final bill that is not there fault, they could say they did and you didn't pay. It is always the consumer's responsibility to follow up on Final Billing.

google how to complain against the collection agency online and it will give you instructions and then get ahold of the credit bureaus and see what they can do. They should be able to put a note on your credit report that it was included in your bankrupcy so that when people look at your report they will see that it was included.

I have provided them with the papers, so has my creditor. Nothing does any good, they're destroying my credit and I don't know what else to do about it! They refuse to accept the fact they're not going to get anything out of me.

Any suggestions on what to do about the second bill in collections? Should I be held responsible for that when they never sent me a bill and can't prove I owe them?

How do I get this stuff off my credit report for good? I need to buy a new car and these guys are making it impossible.

You need to provide your bankruptcy papers to the collection agency that shows that this account was included in the bankruptcy. I see this all the time where a creditor places an account into collections even when they have been provided the bankruptcy documents.

If you are unable to provide those papers to the collection agency have your trustee fax them a letter with the bankruptcy date, the estate number, and the fact you included that creditor in your bankruptcy. The collection agency should close the file and send back to the creditor once that has been done.

There is a number to call to report collection agency's for improper trade practices. It veries for each province however if you google it there is a list of them. Calll them up and send them the letter from your trustee that he sent them about the account being included in your bankrupcy and see what they can do. Fax the same letter to the credit bureau and explain the situation to them, see what they can do. They are easier to deal with because they have no dog in the fight.

Who is the collection agency? Do you have the paperwork from your bankruptcy, it should show a list of all the creditors that were included and you can fax that off to the collection agency.

Hi there,
I have a question about false information being reported to credit bureaus and how to fix it. I got myself into some trouble a few years back and ended up filing bankruptcy. Part of my filing included a cell phone account that was in collections at the time. Apparently they never got the notice because it’s been almost 4 years and they still call me daily harassing me for payment. I have told them several times that it was included in the bankruptcy and they need to call my creditor, which they never have done. I even had my creditor write a letter to them stating that it was included and they need to close the file but no luck. So, how do I go about getting them to believe me? They are ruining all chances of me getting a car loan that I desperately need at the moment since they refuse to accept the fact they are not getting any money out of me. I also recently found out that I have been put back in collections again with the same company for a home phone/cable account that I had almost 2 years ago. When I switched companies they never sent me a bill saying I owed anything (I even lived in that apartment for 10 months afterwards and no bills ever came) and now I’m in collections again. But when I tried to find out what I supposedly owe, no one could tell me. The company would send me a copy of my bill for $4 but only to my old address and refused to tell me over the phone what I “owe” them. How am I supposed to believe I owe them when I never got a bill? And now they can’t, or won’t, prove I owe them at all. Any help you can offer would be greatly appreciated!!
