I sent post dated checks, they were cashing them, 25 a month. Time to renew the checks which I mailed with all pertinent information. Waited, one month goes by not cashed, second month goes by not cashed. Then I receive a letter in the mail with my checks returned! Reading the letter and apparantly these guys do not handle MET Loans any longer. So I continue to read the letter to see who I then forward my payments to,,,nothing,,,,back to square one. Isn't this refusal of payment????? what do I do now?Who do I call?

Came accross this and I enjoyed Raymonds post.... LOL

I have taken a similar approach.

considerations:

If you knowingly and contractually entered into debt, ultimatley you are legally obligated to repay it.

If you accumulated debt unknowingly or without your concent, ultimatley you are not legally obligated to repay it. (be careful, in this case you may end up with a negative credit report, however this can have a positive outcome if you proceed with legal action)

Here is my situation:
October 2007 - recieved an Impark parking ticket while parked in a NON-IMPARK stall.
- contacted Impark to advise them that they improperly ticketed me, I was told that there was nothing that they could do and that I would have to pay the fine. I advised them that I was not paying the fine and they could proceed hoever they felt neccesary, however, I would also proceed accordingly and will persue legal action if neccesary
- I found out later that there is an arbitration process, but was not made aware of that when I inititiated the complaint
- Never recived ANY notification about an amount owing, so I assumed it was over

April 2008 - iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency starts contacting me

1st call - I am caught off guard. Collection Agency? Parking ticket, Oh yeah, I advised iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency that there must have been a mistake because Impark never contacted me about any parking ticket. The advised the agent of the fore mentioned situation, and he said that he would have Impark contact me about the issue then, and that he would close the file.

2nd - Standard questions from iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency - I take control of the conversation after the employee starts getting rude and threatining with me. I started asking for this employee's name and telling him, that I would send him a cheque for $50 personally if he doesn't call me anymore, all I need is his name and address. Of course he doesn't give me his name. So then I asked him how stupid he thought I was, and mentioned that I don't give anyone any money unless I am recieving goods or services, what was he offereing? At this time the guy is infuriated and is yelling at me... HE HE HE. I then advised the person that I considered his phone call harrasing in nature and that if himself or his agency contacted me again that I would be contacting my local police department. And that I still required his name. The employee hung up on me... I traced the call

3rd call - I recognize the number, Horray I get to have more fun. Who is this he asks. I asked Who is this, iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency he responds. I said is this in regards to the other phone calls you made? He said yes. I said so there is no mention that in the last phone call that I advised you that I would be contacting the police if you continued calling me? No, there is no mention of that he said. I replied ok, well that is the case, so I will require you first and last name, and company that you work for for, so that I can give this information to the police. No responce..... LOL, so I continue with, I need to speack to your supervisor as well. WOW, I have never had somone so eger to get their supervisor. HE siad Ok yes I will get my supervisor, can you hold please. I told him that before he goes, I still need his first name and last name, he said he will get a supervisor, CLICK, I wait, wait, wait, Dial Tone.... That rat bastard hung up on me too... I traced the call

So anyways, I will be contacting my Provincial Consumer Protection office tomorrow as well as the Police. I am fully prepared to file a small claim against iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency , which has been advised to me by legal representation. In my province the maximum is $5000 in Small Claims court :( I hope they have filed a credit report against my beurau in which case I will proceed with the supreme court...... Funny all this work for a measly $65 ticket that I will not pay. I am planning on making this ticket pay me, and have been told by me legal representative that it is likely to happen should this proceed any further....

I will keep you posted...

Hint: I have considered other actions such as using my computer to repetedly autodial their number and have an electronic voice repetedly state "this is a test, please hang up now"

In response to a couple of private emails, this is more or less a reprint of my July 23, 2007 post on using the K.I.S.S. method of dealing with collection agents for those who don't want to waste money on lawyers or stamps. Obviously, it's condensed and the language is a bit sanitized for decorum purposes, but the reader should get the idea. The real "Optingout (OO)," as you can see from the thread, was the userid of a fellow who didn't want to deal with collectors over the phone because he found them too intimidating and frightening. [Shudder!]
-----------------------------------------------------------------------------------------------------------------------------------------------------------------

Fair enough, if you don't owe it, then don't pay it. You don't have to prove that you don't owe it; they have to prove you do. This ain't like the reverse onus Highway 407 (Toll) Act. Therefore, you don't have anything to worry about so I don't know why you are.

I gave you an infallible script in step no. 7; however, if you don't like that one, try this one:

[Ring, Ring, Ring]
Optingout (OO): Hello

collection agencys 'R Us [Collection Agency] (VRU): Is Optingout there?

OO: Speaking.

VRU: We've been calling you about this phone bill now for 2 weeks and my supervisor is getting sick and tired of waiting for you to pay up. I told you, he hates losers and deadbeats. I can't hold him back any longer from hauling your ass into court. Maybe, just maybe, if you can get the cash in to us today, I can get him to put a hold on the court action. Otherwise, we're gonna have your balls for bookends...... You got that?

OO: Really? Well, you good for nothing, bottom feeding jackals will have to sue me to get a penny, cause I don't owe this money. That is if you collection agencies can take the time from chasing down accident victims, cancer patients and guys who have just lost their jobs to do that. Speaking of jobs, do you think you will ever go out and get a real one and stop being a parasite, leech and general all-around boil on the ass of humanity chasing down wheelchair victims?

VRU: I don't have to take this abuse - it's harassment. I do a valuable job for society.

OO: You have a job? Sorry, Bros, what you have is a joke, not a job. A job by defintion is something useful that someone does for society, like a teacher, a truck driver, a doctor, a janitor. Even a guy who scrapes up dead animals off the road does something useful - unlike you. Unless you want to consider a pimp, a drug pusher, a hooker, a b&e artist a "job."

Listen, there's a train leaving town at 6:00 P.M. Why not do the world a favor and be under it?

VRU: I'm not going to take this abuse; if you don't stop, I'm going to charge you with harassment.

OO: Man bites dog! Bow Wow! Try digging up some other bone, you mongrel.

VRU: Click!

Playwright's footnote: Notice, that at no time, did "OO" ever allow himself to enter into any discussion about the bill. He kept the emphasis on the collector's character (or lack thereof).

LOOKOUT BELOW!!

If you want someone "to crap over you," try standing under this iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency collection agency.
----------------------------------------------------------------------------------------------------------------------------------------------------------------------

I expect a person to be man enough to defend themselves, especially for something this trivial. Besides, why deprive yourself of the fun of dealing with the collection agencies one on one?

But hey, each to his own; that's why I said, "If someone wants to waste money on a lawyer, that's their perogative." Just don't B.S. me that they need to. I would have gotten rid of iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency "gratis", "on the house", "free of charge" in 2 minutes flat.

Been there, done that.

Oh, for pete's sake, Ray. Ya bitch cause nobody does anything about this and then ya go and say crap like this to somebody who wants to do something.

You can try a cease and desist letter from a lawyer, and it may help. You can try reporting them to the government agency... they may help.

Myself, I would send them a registered letter stating that the person they are looking for does not reside at your home, and nor do you know where they live. Request that they do not contact you again or you will take them to court... then go to small claims court to file against them.

Well, go ahead and hire a lawyer if you have some masochistic compulsion to waste money needlessly.
