Whyme... don't even speak to them. Tell them that you have handed the file to your lawyer and all further discussions with regards to this loan are to be handled through him... and give them his number. They can then no longer contact you about this.

Never repeat yourself. Say what you have to say once then hang up. When you repeat yourself you give them the opportunity to abuse and "tenderize" you.

Hey whyme

If the debt is business related, consumer protection won't help you.
You're on your own...

If the debt is signed personally by you (IE. consumer related ) ... then Consumer Protection will help you.

If you're getting collection calls regarding a debt that is under your businesses name, talking to a lawyer is the only way to go.

QUESTION: Are you personally signed on this debt? Is this debt going to affect your personal credit report?

Well..it was all quiet for the wk then on Friday they called me at work...I told her I had no intentions of discussing anything with her while i was at work..so you are refusing to deal with this, she said..let me get this on tape..when I told her she cannot call me at work, she said she can and will call me where ever she pleases...then she said she had another person on the line and did he hear that...and that this is a conference call..and did I just say I was refusing to pay this loan..then I said...I am telling you I will not deal with this issue at work...I repeated it several times then said have a nice day and hung up. Not 5 min lateer, her boss, Gus calls...and tells me he has the person whose name is on the line of credit on the phone and that I need to have a conference call...and that he has prrof that my name is on the papers...great, I said, please fax them to and I gave them a number...then I said, I will not have this conversation or any conversation with you while I am work...then I said have a nice day and goodbye. I didn't hear back from them. When I got a chance I checked my cell phone and there was a call from them on it. They didn't leave a message. There were no calls at my home from them. I had a conversation with Gus where I told him he cannot call my cell phone or my work and he agreed he wouldn't...so that lasted 4 days. I expect they will not stop calling.

I printed off the Complainant form from Sask. Justice. It says "the branch does not deal with disputes between businesses". I am not sure how to interept this. I am part owner of the business who they claim hholds this line of credit, even tho the bank has told us it is soley in the name of the original owner..and my lawyer says that just because I purchases his shares in the compnay does not mean I purchases the debt that he personally guarenteed. The loan is with a bank. Collectcorp is telling me I am fully responsible for his loan because I bought his shares and he has now sent these papers to them. Do I still have a claim with Sk. Justice. I am willing to fill in the form and send it to them. Do I need to discuss with Collectcorp that I am filing a complaint against them?

There were a couple. I'd have to research who they were, cause I don't remember.

Whyme has grounds based on harassment, intimidation, and, possibly, harassment. Potentially mental anguish as well.

Angella...I was just wondering if you knew of any cases that a person successfully sued a collection agency for threatening calls and actually was awarded damages.

Oh it was contact alright...she called my cellphone..I just rec'd the bill and the charges are for over 140 minutes of Long distance. remember, I was in Ontario when she first made contact with me. She left me numerous voice mails. When I would answer, she said why didn't you call me back..I've left you several messages. I told her I was unable to retrive my messages and she said "that is not my problem". She would give me deadlines...you must call me by 2pm or I will be calling your company for the money. When I called her from my relatives house, she called me back on that number twice.

I now have the credit card company dispute dept. looking into reversing the charge. This is far from over yet...

I am so glad I found this sight and did all the reading that I did. I feel empowered to deal with this...I could have saved myself a great deal of anguish if I had this information ahead of time but, as I mentioned...this is a first time for me. I absolutely had no idea how any of this worked..and how blood sucking these collection agencies can be...I can't imagine doing anything like that for an entire day and then going home to my family...

I guess what makes me feel most gullable is the fact that I gave into them on day 2...just taking their word for it that I owed this money...I mean, how else would they know the amount, know where to find me, know what available amt I had on my credit card...I thought it was god looking down on me...they know everything about me...where I worked..she said she phoned me there..knew I was on holidays...she said..how nice..you can afford a vacation!!

More than anything, I want to call them now everyday, demanding this contract with my name on it...and wanting it TODAY!! I truly would find some justice in that...

Hi Angella,

Do you know of any cases where someone was actually successful suing a collection agency in Ontario? Also, how much can you sue for?

Actually, come to think of it, I think your best option is to cancel the card. You have to be made of a certain constitution to tackle the collection agencies head on. You have to know your laws inside out and backwards. You have to be able to deal with their crap without being reduced to tears.

Cancel the card. Refer the collection agency to your lawyer... even have him send a letter indicating he has been retained by you to deal with this issue and all further contacts are to be made through him.

Once that is done, they cannot contact you. Ever. If they call, record the date and time of the call and hang up. You may want to say "all calls are to be made to my lawyer at (insert phone number here) before you hang up.

Do NOT talk to them. They can't stress you out and make you cry if you don't talk to them. They cannot call your boss. They cannot call your family. If they do, it is harassment and you can sue them.
