Did you get a settlement agreement beforehand and a release letter afterwards?

i have been getting calls from these ppl about a out standing debt i gave them a oayout and they keep saying i am still owing money what am i suppose to do? they didnt give me a number to call back please help thanks

You don't really explain your situation in this post so it is impossible to give you advice with respect to that.

The one thing that can be explained is the Brick Card. I think Brick uses HSBC for their cards and the current situation has nothing to do with them directly. What happened though was that applying for the Brick Card updated your credit file and now they have your current contact info and more importantly they know you are a live and seeking credit. That brings the collection agencies out of the woodwork because they see activity and people seeking credit are easier to intimidate into paying old debts.

Hi Guys It me again Bellbox . I writing again because its been a long road here with this collection crap. This is still going since May 2007.
I have called them talked to them and sent letter reqesting info regards the acount and amount.
They have not sent me any info as of yet , I have recieved no phone calls but perhaps thay dont have my #, They keep sending me these letters by mail about every 3 to 6 months . From what info they told me on the phone they had my birthdate wrong and had a addy for a P.O. Box In Mississauga , But seemed to have my SIN # correct....... this worry's me SomeWhat.
I went to have a chat with a Lawyer and told me to sit on it..If they were going to take me to court it would of happend by now...... He also said If thay take me to court and i losse the case I will have to pay the full judgement amount and court costs and intrest

Im so worried since the intrest amount keeps going up !!!.

I just dont know what else to do..

I also would like to verify if what the lawyer said is valid since this debt file must go back to the mid 80'S and intrest in mounting 15-18,000.00 by know.

Can this collection company have any valid rights to collect this monies ???

And what else can i do to stop them.

PS. I also like to add this all started 2-3 months after i applyed for a Platinum Brick Credit Card In Dec of 2006 . Like to know how owns and controls that card to see if there a link to this problem.
I have the card but never called to activate it , would it still be on file as open...... and if this card is controlled by Citi Bank Can they use my info to collect old debt.......????

To get a default judgment against someone you have to appear before the Clerk and either swear an affidavit to how the documents were severed in person and if they were files any other way then documentation is necessary.

Based on your other post it most likely appears that you became unserviceable and that the creditor appeared before a judge and got permission for alternative service. That you claim to have never received the default judgment would imply that the creditor was unable to find you and made an argument that you were frustrating service. The default judgment would come directly from the court house.

If they are going to garnish you the process does not involve you. In fact I'm not even sure if they have to contact you. They serve your employer directly.

If you want to get this cleared up first thing you need to know is what court house this happened in. Go to that court house in person with your case number and ask the Clerk for the details. Come back -- start a new topic -- post the details.

To be honest it seems like a creditor managed to get a default judgment against you by taking advantage of the fact that you did not respond and that failure to respond is almost automatically a win regardless of the legal status of the debt.

I would like to hear from members who appear to have judgments against them without having been served to appear in court, and also people who have received garnishment letters without some form of due process.

I would take that piece of paper and throw it in the garbage. The only way someone can garnish a bank account or wage is with a judgment awarded by a court. I would not tell them where you bank and do not give them any banking information. I would not fall for their scare tactics and just ignore them, because there is nothing they can do now but feed you lies to make you pay.

thanks Joe..but is it possible for them to take money out of my bank? they sent me a CPP today and then they want to make me pay tomorrow!
