A few answers to some questions will help clarify your situation.

1. To whom do you owe this debt?

2. What is the amount of the debt that the collection agency is claiming

you
owe and do you agree with this amount? If you disagree with this

amount, why do you disagree and in your opinion what should the

amount be?

3. What was the exact date that you last made a payment on this debt and

what was the amount of the payment? Did you acknowledge this debt
in writing and signed by you at any time?

4. Is this debt a credit card debt and was the application for the credit
card signed in Alberta?

5. Does this debt appear on your credit report as a "trade line" and when
is the date that it was last reported?

6. Does this debt appear on your credit report as a "collection item" and
when is the date that it was reported? Does it appear on Equifax or

TransUnion or both or neither?

If you can answer these questions, then I can offer you some guidance as to what your options are and how to proceed.

I do have information from the law society of Alberta, and it states as a consumer you can ask for debt validation. Whether the collection agency will provide it is a different story...I am planning on paying for the filing fees for small claims court in Alberta. The collection agency is in BC, and I know for a fact she cannot take me to small claims court in BC, and it would cost her more than the debt amount to bring this to the Alberta small claims court. I would like to get this resolve, because it depends on the future of my special needs children being able to partake in therapy sports to assist them further along in becomes more independant.

In a previous post, you talked about "Debt Validation". Debt Validation is not legal in Canada, therefore, any request to a collection agency for validation of a debt will be ignored. Debt Validation is legal in the U.S. but it only applies to collection agencies, not to the original creditor. Under U.S. law, the collection agency has 30 days to respond to the Debt Validation request, otherwise, the collection agency must remove this item from the consumer's credit file.

PLEASE NOTE: Be very careful when you are reading credit information websites. Many of them are U.S. based and most readers believe that what they read also applies in Canada. This results in misunderstandings among debtors, creditors and collection agencies. If you are unclear if a particular rule or law applies in Canada, do your due diligence ( research ) or ask the question on this website. Usually, someone will have an answer for you.

Thank you.Yes, I would definitely like some more information. The debt occurred here in Alberta, however, the collection agency is based out of Nanaimo , Bc. I sent her the last registered letter on August 27th is when she received it.

She had threaten to take me to court, and told me no Judge would ever listen to my story. I said ok, I am willing to tell my story, as I am at not intimidated to face a Judge. She also laugh and smirked at me when I offered her twice to settle the debt. I asked her in the letter not to contact me via phone, and I get a phone vm from her.

How do I email you regarding more information.

Yes they are required to provide statements and even original loan documents from the creditor. If not, you can go to the creditor directly and request this. While you're at it you can complain to the creditor that the collection agency is being difficult with you.

Don't get scared about them threatening you with legal action. In fact, they are not even allowed to do that unless they intend to do so. However, there are a few conditions that need to be done before it can get to that point.

What I had hoped from the letter is that she would send me validation of the debt. I have sent her another registerd letter, letting her know that the information was indeed American credit laws, and I am now aware of that.

However, As a Consumer I do have the right to ask for Validation of the debt, and to also ask her to inform me of when is she going to take me to court, because I would like to get this matter resolved. By putting this debt on my credit bureau, she has stopped any chances of me every being able to afford the needs of both my special needs children.

Becasue of this debt, my special needs children cannot attend the recreation/sports therapy they must attend, to assist them in daily living with special needs. My bank will not give me the line of credit needed for the funding of their therapy/sports because of this collection report on my file.

I am hoping to tell the Judge my story, and hope for leniency or at least only have to pay what I believe would be fair.

More details please.

So you received a letter from a collection agency regarding an outstanding account?

You can't just go on the internet and copy and paste any text, read the collection act and you will know how to protect yourself.

What are you trying to accomplish with this letter?

I got a letter from the collection agency today and siad that what

I copy and pasted was from american law collection agencies and as she is laughing at me she states to me they do not understand the US credit law, or chinese crdit law, or australian credit law or any other law that is not canadian...I think what a jerk.....Does any have any advice as to whaqt to do about this collection agency who cannot sue me because they are in bc and im in alberta, but has gone ahead and put the debt on my credit bureau.
