Here is the complete version of the Personal Information Protection and Electronic Documents Act (PIPEDA) on the department of Justice Website:

Hi OC,heres what Capital One told me, I'm trying to get copies of any correspondence.
The purpose of the access to personal information requests under pipeda is to allow a person to obtain information an organization may have on file,which that person has not already been provided or may not otherwise have been privy to. Therefore statements you have already received and correspondence sent or received you should already have in your records.
We will therefore not be providing copies of these documents.

On the surface that would make sense but I need to know that my communications were received by them and that I am not missing anything from their end. Also be interested to see if any handwritten notes appear.
I cannot see under PIPEDA any info that backs up Capital One's comment, you know of anything?

First request a copy of your credit files from both Equifax and Trans Union. If you fail to uncover the source of your debts after doing that, then perhaps request this information from the C/A under PIPEDA.

Here's a template that you can modify to your specific needs:

Your Name
Address

[DATE]

Privacy Officer's Name
Company
Compliance Dept.
Address
City, Province
Postal Code

I am writing you in connection with the above-noted account.

This letter will confirm that, under the Personal Information Protection and Electronic Documents Act (PIPEDA), I wish to obtain a copy of all records containing my personal information.

More specifically, I am requesting copies of the following records:

Any recorded telephone conversations with respect to my account involving employees of XYZ or the company's affiliates (i.e. 3rd party agencies);

The contents of your electronic file on my above-noted account, including but not limited to the note lines;

The contents of any hard copy file in connection with the above-noted account;

Outgoing correspondence with respect to my file including any documents sent by regular mail, courier, facsimile (including fax cover sheets) or e-mail;

Incoming correspondence with respect to my file including any documents received by regular mail, courier, facsimile or e-mail;

All contracts that contain my signature;

Any credit reports in your possession.

I understand that under PIPEDA, you have 30 days from the date you receive this letter to provide me with any records containing my personal information, except where you satisfy the conditions for a 30-day extension, in which case you have 60 days from the date of receiving this letter to provide me with copies of the requested personal information.

Regards,

Your Name

cc: Office of the Privacy Commissioner of Canada

P.S. You don't need to cc the Office of the Privacy Commissioner of Canada, I just included it to add a little extra impact to my request - which was effective with RBC.

Why is it so hard to pay back your debts?

Postby thetank » Tue Aug 10, 2010 02:51:55 PM

I want to pay back all my debts in full. Lot's have gone to collection agencies.

I am having the hardest time trying to track down who I owe money too, because it has been forwarded to collection agencies. Even if I find a collection agencies after, four hours of searching, they refuse to mail me a copy of my debt.

Is there a more logical way of finding who you owe money too? and how to verify, or have it in writing.

Thanks

PS I don't want to consolidate or claim bankruptcy.

Thanks again.
