funding problem

My name is Carson, 35. My wife, Lizzie, 31 had to cancel a purchase due to a funding problem. Now, the seller won't release her $3,250 deposit from escrow. I just want to know if this is legal. And what if the seller doesn't release it? What eventually happens to the money?
