I would question how one company has the right to transfer your personal information over to another collection agency. Is that written in the contract some where?

Secondly, good point about the unlicensed collection agent. This happens alot.. People need to always as the collection agent for proof that they're licensed in that province. Many times the collection agent and collection agency are not licensed to do business in your province.

If you're getting called from an unlicensed collection agency, that phone call is illegal, and you need to complain to consumer protection, just as Marilyn has done.

Total Credit Recovery/Common Collection Agency

Postby marjm » Fri Jun 09, 2006 12:00:00 AM

Good afternoon:
Since I had Total Credit Recovery investigated by Consumer & Corporate Affairs & have proven their agent was unlicenced, they turned by "account" over to Common Collection Agency. Rob from Common Collection Agency called me at work before he even attempted to call me at home. I told him I would not take calls at work & wanted a copy of the contract I would have signed for this Mastercard. He said he would send it but it could take up to a month for me to receive it. Good luck to him because I never signed any contract & I said right from the start this was another family member's account not mine. Anyway no copy has come to date but they did send me a letter asking me to pay the amount owing. I have not acknowledged this letter & won't until I see prove as to who they are, their licences, a copy of this contract which they insist is mine.
The person who does owe the money had told the bank it was him when this first started. When he left work due to health reasons he tried to pay as much as he could but of course this was not good enough. I know I can sue Total Credit Recovery & if I can do so without costing me a lot of money I will.
Anyway does anyone have any more advise as to what I can do. They have threatened in the past to garnishee my wages but as I didn't do what the claim & there is no contract they have so far not managed to do so.
