Yes, it's almost always a good idea for your creditors to be able to communicate with you so that you can find out what they are up to - although you usually have to read between the lines. But NEVER divulge any information about yourself other than perhaps your name and mailing address. Creditors will ALWAYS use anything you say against you if they can.

Ray,

TCR is on my case for some account, just can't recall which one. They now have some Lawyer, Mr. Antel (sp?) sending me letters and leaving VM's. I would normally have the letter handy, however, I just dropped it off at my accountants earlier today.

Any idea if this is a chap you've heard of before? Think I should have a chat with him, or..?

Be careful, they may well have authority from the credit card company already. TCR is possibly the nastiest prick in the entire country, maybe the world - or the entire galaxy if there's extra terrestial life.

How much do you owe? And which card is it?

I am so new to this that it isn't funny. Am I able to contact the credit card company themselves and find out what is going on, and to try and make arrangements with them, even though TCR is contacting me?

LOL who does she think she is? She sue you? what a joke. Next time if you talk to her, call her bluff and tell her to sue you. Ask her if she IS the creditor or your credit card company still is the creditor. Tell her if she say they're going to take legal action against but actually aren't, they break the Collection Agency Act already. They apparently won't sue you because if they want to, they sue you long time ago already. It's just a scare tactics they commonly use. Furthermore, they can't just go ahead and sue you since they need an approval from the creditor. They are merely an agency and they have no right whatsoever of how to proceed further with your debt.

I have tried to come up with the money to pay the settlement, and have been unsuccessful. The guy dealing with my case has been canned and I am now dealing with a bitch named Brianne. She is a nasty, condescending little girl who seems to think the money is coming out of her pocket if I can't pay it. Well I have tried to make arrangements to make payments but was told SHE will sue me because it is a demand loan. I said I would call the Credit Card company and see what they have to say and she said she didn't care, she was suing me anyway. I asked if TCR is a collection agency why wouldn't they accept payments as others do.....no response. What can I do? I;m starting to get scared.

Well, the zombied out collection agencies at TCR usually go after accident victims; That's what scavengers do. They would have sued you by now if it was worthwhile and they had the creditor's permission.

So I guess that means they'll just have to take whatever you decide to send them. If not, they can take you to small claims court, and the terms they'll get there probably won't be very good for them if you explain your situation to the judge.

Call their bluff.

P.G.,

Before you send them any money, have the Collection Agency send you the terms in writing. These people are quite shady; and you want to ensure that your payments are being applied to the settlement amount and not the full balance.

You can find other great info on this site, but the above is a good tidbit to anchor into one's brain.
