I was wondering if anyone could give me some advice. I received a call a few weeks ago from a collection agency for a 2005 payday loan. I honestly don't remember the loan, but the man I spoke with told me that they were calling to collect on behalf of the payday loan place. He told me that I had 48 hours to pay up or they were going to do some kind of asset search on me and freeze my bank accounts, take my tax returns or even put a lien on my husband's vehicle. He also said that it was pricey to do this and I would probably end up having the cost put onto me. I explained that I didn't remember the debt, but I didn't want my husband to end up with a lien on his vehicle. I explained that I am a stay home mom with limited income, but I would try to come with half, and another half the following month. The amount is under $300.
After hanging up with him, I did some research online and found out they needed to send my something in writing. When he called back a couple of days later I told him that I would like something in writing. He told me that he would email it. I refused. I told him to mail it to me. He told me that it was nothing but a stall tactic. I told him that until I got something in writing, I would not be dealing with them. He called me the following week and asked if I got the letter. I told him no, and he called me a liar. I hung up on him. He called me again a few days ago and asked if I got my letter. I told him I was still waiting for it. He again called me a liar, and told me to give him my email address. I told him no, as I wasn't going to give him another way to harass me. He told me to quit stalling and I told him to send me my letter. He said they were going to proceed against me.
Now that I've explained everything, what I want to know is, are they able to do what they said? And what are my rights in this? Any advice would be greatly appreciated.
