If the last payment was six years ago then the debt is stat barred. They can't take you to court or make you pay it. They can't even report it on your credit report.

Do not communicate with them in writing or your might reset the SoL clock.

Tell them to stop calling and to either sue you or **** off. They know they can't.

I have dealt with these boneheads before. I would send them a cease and desist letter. If the last time you made a payment on this account was six years and you’re in Ontario, this account is considered stats barred and you can longer be sued and you will be fine. I would cut all communications and if they keep calling you; I would make a complaint with the collections registrar in your province. I believe I provided the information to you.

I have made a payment on this its from like 6 years ago from my ex, they just contacted me at work actually and continued to to harrass my co workers and give confidentiality information to my one co worker. Its contact Resource service.

How much is your debt and when was the last time you made a payment on the account? Which collection agency is giving you a hard time? The collection agencies are in the business of collecting and not suing.

Thanks so much! I tried calling today to speak to the manager so I can get someone id number as I'm trying to make a case against them. The last phone call that was made to me she told me to go ##$$#@ myself and now all of the sudden the recording message has disappeared? All I asked was for them to wait until I recieve my stuff in the mail from exquifax so I can consolidate. But they refused they even refused a payment of $40.00 can they do that? So now they said they are going to take me to court and have my wages garnished....I told them I'm a single girl living on my own and cant afford that and if they arent willing to wait than I'm going to have to claim bankruptcy cause I wont have any other choice......but they refused. Mean ol buggers!

Does anyone know where or who you can put in a complaint regarding harrassment calls? This company has continued to call my work number, harrassing my poor co workers and give them confidentiality information about me.
They are awful company, not willing to negotiate, they wanted me to take the settlement and when I said no I cant do they are now stating they are going to take me to court to start garnishing my wages. Does anyways know how much they can garnish up too?

I find the creditors do not re-date the date of last activity, it's the collection agencies that do it when they input their information and they know the item is ready to fall off. I believe the creditor should be the only one allowed to input their information in your credit file unless they sold the debt.
