If they can give you a claim number then you can verify their story with the court. If they cant, or don’t want to, it’s unlikely that they ever did sue you. If they had a judgment they would have already been garnishing your income. They usually don’t threaten to garn if they already have their judgment they just do it and wait for you to call them.

Either way, it doesn't sound like they are garnishing your pay so if they do or they don’t have a judgment why cry over spilt milk until you find out?

Ottawa,

I hear what you’re saying, just in case you moved and they could not serve you.

Cheers

Joe, I hear what you're saying... But, sometimes it's just wise to play it safe Dude. That's my 2 cents on the subject anyway.

When a collection agency threatens to sue you, the claim is always bogus. If a creditor sues you, they will have a lawyer that filed the papers try to collect first and if that doesn’t work, they send it off to a collection agency.

I would go down to the court house because if you have moved they can serve papers on your without your knowledge and you do not have to go to court to have a judgement against you. Once you have the paperwork or if the court house has nothing on file then it does't exist, try and phone the original creditor and make arrangements.

If you haven't been served any papers, then there is no judgment against you and she is lying to you. I wouldn't waste your time going down to the court house. If anyone is going to sue you it will be the creditor and not the collection agency. When was the last time you made a payment on this account and what is the original balance before you stopped making the payments?

Hi,
need some help on a judgment made against me. long story short, took out a loan, thought ipaid it off I actually forgot about it (not lying seriously). There is a judgment in court against me from contact resourse services, now they want to garnish wages. I have not been served any paperwork. Talked to the gal there, asked for statement, account balance etc. to be sent to me via email, mail, courier. she balked at that. so now going down to court to find my copies of paperwork. Told her i'll gladly pay off(it's only 5100) but it's gonna be about 11/2 months. what should I do?
this is stressing me out.
need help now
