YOu don't have a contract with a collection agency.
As I always recommend, ask the collection agent to show proof that he is licensed in your province. Both the collection agent and the collection agency must be licensed in your province. If they don't show you proof, the phone call is illegal.
Secondly, you don't owe the collection agency ANY money. You haven't signed any agreement with the collection agency. You don't owe them anything.
You do however owe the original creditor.
I would suggest you get a copy of the original contract with Capital One and see what you agreed to. Also, I would recommend getting a copy of your credit report to see how Capital one is reporting you.
It's really important to pay off the debt to ensure you credit report doesn't get messed up.
The worst that the collection agency can do is recommend to the creditor that the creditor take you to small claims court.
RECOMMENDED:
1) Ask the collection agency for proof that he's licensed. You have to see proof.
2) Look at the contract to make sure what you agreed to with Capital One MasterCard.
Collection agencies have to abide by laws. Don't be bullied by them.
