The BC limitation period for most unsecured debts like loans and credit cards is 6 years as per Section 3.5 of the BC Limitations Act. Thus, if they haven't filed by now and it's not a student loan, it certainly can't be revived or renewed. It's just as dead as the brain dead zombie who called you. But, as I said, it's getting close to Christmas bonus time, and collectors have nestlings with hungry beaks to feed at home too.

See my earlier remarks on ANI phone software. I don't know if ARC has it but it ought to be a moot point. Almost always, you should want any collection agency coming after you to find you. That way you know what your enemies are up to. The worst thing to fear is for them to sneek a stats barred debt past the judge and obtain a default judgment. In BC, a statement of claim for court action must be served by registered mail or personal service. But that didn't prevent ARO from sneeking in a default judgment against blogger "KatintheHat."

A R C calling for a 12 years debt

Postby netsurfer » Wed Nov 19, 2008 01:44:16 PM

I have been contacted by A R C so far twice in 5 days. When the first call came in someone in my house hold took the call and I was left a name and number to call before 5 pm the same day. I did ignore and never returned the call. I got called back few days later and this time I had to take the phone the collector stated his name and the company he works for and asked me to verify my birth date. I told him I have nothing to say to him and hung up. He called back right away and left a voice mail with his name number and told me to call back to take care of my responsibilities. He also stated the last known address he has is back to 12 years ago and asked for my new address. I have not made any contact with him at all to this date. Now I did some research on this website and others and learned about " Time barred debt " and " statute of Limitation ". Just to clear things here the debt he is after is in BC and I have moved away since then to Ontario. My question is can they still come after me? any feed back about skip tracing? I never acknowleged the debt to be mine or gave any personal info. I was able to get a credit card in the last 5 years. My name is also on a mortgage. Your feedback is greatly appreciated.
