Has anyone applied for a Secured Equity Line Visa from Home Trust? My husband and I did it last year to transfer our Capital Direct Outstanding Balance to a Secured Equity Line Visa from Home Trust because I thought carrying a Visa account will help us to improve our Credit Score while Capital Direct doesn't. Therefore, we transferred our second mortgage from Capital Direct to Home Trust and got a Secured Visa.
This year, focussing on getting better interest rate, we applied to RBC and finally got approved for a secured loan. This means that we now have to close our Secured Visa Account with Home Trust in order to activate the secured loan with RBC.
However, the unthinkable happened. My husband's credit card got stolen from his place of work and charged three unauthorized transactions. This occurred last July 4. We immediately reported the credit card stolen and promptly filed a police report.
However, two weeks after the fact, I started getting frustrated that the unauthorized transactions were still part of my outstanding balance. I began calling Customer Service, then Fraud Department to ask them when this will get resolved. Still not getting any response, I escalated the matter to the Ombudsman. Only then, someone told me that they have started the investigation, which by the way, will take about 60 days to complete. So, when I informed them that I am closing the account, the Senior Manager responded to me that I need to pay the entire balance including the disputed transactions in order to release the lien. And if they determined that the disputed transactions are not really ours, then, they will reimburse us the amount.
What happened to the Visa Zero Liability policy? Should I start looking for a legal counsel so we can sue Home Trust. My friend who is a Toronto Police Officer told me to wait for a month. Tell me what you think.
