You don't list your province but the SoL on consumer debt is 2 years in Ontario. It use to be 6 years but that changed in on January 1 2004. Debt defaulted on in 2003 would have the old 6 year limitation but even if you defaulted on the last possible day it would have become stat barred 11 days ago.

I think this is just a scare tactic. No one calls to warn that they are going to serve you. What is the point of doing that? Giving people warning so they can hide assets and frustrate serving is hardly something someone who is actually going to sue you would do.

My guess is that the debt is stat barred and this is an attempt to get you to do something that will reset the clock. Be careful to not accidentally acknowledge the debt.

i too was just contacted by Mr.seargent from Paul Kupfersteins office. first time ive heard from them or of them was today when mr seargent called me and asked me why i had not replied to the documents sent to me a year ago( which i never received). asking me if i had legal representation as i was receiving court papers and summons tomorrow for a debt in 2004.he continued to belittle me call me stupid and ask me why i cant read, i was told the statute of limitations was 2 years on collections so i believe im well over that being as its 6 years now but mr seargent told me it was 7. this has totally ruined my day.almost my marriage as my husband freaked out saying i brought more baggage to the table.and understand the collection was from someone else using my stubs to get a payday loan and when i went in to freak out i was kicked off the property and told if i came back they would call the police on me.so here i am 6 years later dealing with the wrath of someone else.

I have had many telephone calls and e-mails from various people who have been harassed and threatened by Paul Kupferstein's Law Office and his monions, and I thank you all very much.

Again, as Mr. Kupferstein is responsible for his staff's conduct, and as his staff are violating not only the Rules of Professional Conduct, but also the Criminal Code of Canada, and he is responsible for any damages you may have suffered.

Mr. Kupferstein's staff is not allowed to call your employer, your friends, your neighbours, your relatives, your parents or grandparents in order to collect this debt.

If Mr. Kupferstein's staff does this, you can sue them.

My firm would be most agreeable to being retained by anyone who want to sue Paul Kupferstein for harassment and damages.

I bill my time at $150.00 per hour, and I request a retainer up front of $500 plus 5% GST, and I look after all steps of the action.

The limit in Small Claims Court in Ontario is $10 000, but on 1 January 2010, that limit rises to $25 000.

And Mr. Kupferstein is not going to be thrilled about any matter such as this get in front of a judge.

Allison your thoughts are interesting however how do you prove because most of the dealings with these companies is on the phone. The courts already look at yiou like you skipped out on the debts in the first place. You need facts and paper to prove these sorts of things in court and the guide lines for collection agencies is liberal. Usually they operate just inside the line of legal.

I always tell members on here that if they are not happy with the collection agency, you can always settle your debt directly with the creditor’s collection department. All you have to tell the creditor; the collection agency is treating you unfairly and they will be glad to assist you. I don’t think all these threats of lawsuits, will settle your debt right away.

Just to let everyone know, I have posted on this forum as well as other forums, in repsect to the conduct of Mr. Kupferstein's office and staff, and Ihave been retained by two parties so far to commence civil action against Mr. Kupferstein's practice.

I am licensed by the Law Society of Upper Canada, and all of the right not be harassed and threatened by people suchas Mr. Kupferstein's minions.

There was someone that posted here a while back that was suing a collection agency; I think it was "vampchick" or "angela".

Does anyone know if she was successful?

She claims to be a paralegal, yet articulates herself as if she struggled through grade 5 English classes. Its apparent that her post speaks volumes for the quality of services she might provide some poor sucker.
