• I just found these recent updates on this Money Mart Class Action Website which seems to be hosted by SUTTS, STROSBERG LLP law firm.


    15. On October 12, 2006, the Supreme Court of Canada dismissed Dollar Financial's application for leave to appeal from the jurisdiction decision of the Court of Appeal for Ontario.

    16. The Franchisees have undertaken and agreed to be bound, if the action is certified, by any declaration made by the court in relation to s. 347 of the Criminal Code.

    17. The certification motion was argued on October 25, 26 and 27, 2006 before Madam Justice Alexandra Hoy. She reserved.

hmm Aug 29th, still no cheque - being in the group of "missed" people they have no idea when I am going to get my money because Money Mart has to pay me now as the settlement $$ has already been divided up and there is no money left....hmmm, as stated before, thought getting screwed would feel better....

Hi As of today, no one in ontario have received a cheque because they have not sent them yet. Apparently their was an issue with the third party who produced the cheques.
I know all of BC settelemnt have received their cheque. Perhaps we should all call Head Office in BC and start complaining. Maybe another class action suite for the delay in processing these cheques will make them produce the cheques faster or let us receive the amounts from our local branch.

I called the 1-888 number on Friday July 22nd. I was on hold for over 1 hour. I was told that any cash credits amounts over $200.00 a cheque would be issued and they can only issue 1,000 cheques per weekand yes, you do have to call to confirm your address and full name to receive a cheque. If your credit is less than $200.00 you can receive your money form your local Money Mart. I really don't think it's fair that members with more than $200.00 credit have to wait almost a month to receive their cheque.

followup to my comment on the 21st - I called the branch I had the form faxed from and the manager there looked into it (being one of the smart people on the planet, she had saved the fax transmittal forms and found mine) and sent that to whomever it needed to be sent to. It seems that there is a group of us who were "missed" and it should be cleared up by the end of this week.

Called them again today. Now they tell me that a "team" is being put together to prepare 1,000 cheques per week. They are being told to tell clients not to expect a cheque until the first two weeks in August. This is for Ontario. As usual, payouts under $200 are to be paid out at a Money Mart location. They will not automatically mail out cheques - you need to call 1-866-504-7237 to confirm your address and to let them know you want your payment mailed to you. At this time they CAN tell you the amount by phone.

I feel sorry for everyone that is having a hard time. I live in B.C and luckily haven't had a problem. My cheque came back around the middle of July. I guess it's being paid out differently in this province because it was under $200 but they did it in cheque form. I also received a letter to take into the branch to get what I'm owed in credits.

You need to call 1866 504 7237 to request your cheque if it is over $200 dollars, if under that amount it has to be claimed at a moneymart facility. They are not automatically mailing out the funds.

others say there is

no one knows

the way i see it 20 % on payday loans for 2 weeks works out to over 520 % per annum and adds to the misery of their typical clientele myself included

The thing that really irritates me is on July 21st if you haven't received your cheque then they will reissue another cheque. I have offered to pay for registry mail so that I at least am assured the cheque will be received buy yes you guessed it," we are only to follow the court order process of mailing your cheque through regular mail. To me is sounds like a stall.

I even went as far as asking for proof of existence of a cheque and was told they have a spreadsheet containing our info and a cheque ID number. Well were getting somewhere but when asked about who the bank is..." sorry but I do not have that information".

I agree with Bob, maybe another class action suit might jolt them off tehir chairs.

I called a Money Mart Branch on Tuesday, they told me they could not release any information over the phone so I went in to a branch and inquired but the person working there did not know how they were handling the situation and gave me this number to call 1-866-504-7237.

On Thurday I called the number, was quite a long wait for someone to come on the line, in any event, they advised me that I would be getting equivalent to half of the transacation credits that were calculated last year. If you are receiving less than $200 they will give it to you at any branch, however if more when you call the number they will ask you to confirm your address to be sure they send your cheque to the correct address.

Now I dont know how they came up with this whole calcuation of the transacation credits, what I do know is that I paid thousands in interest alone over several years and to receive a few hundred dollars as recovery of this obsurd amount of interest and having waited so many years for this settlement is very dissapointing to say the least. It is better than nothing but can not even help with the financial burden I have been put under along with many others. In the end the lawyers are the winners in this settlemnt because they get millions.

All other pieces of mail have showed up, just not Money Mart's. That's not a coincidence or CP, it's bull patties! Supposedly if it isn't here by the 21st, they can reissue a cheque. HOWEVER, only after you sign a waiver saying you won't cash the other one IF it shows up. That assumes that they will even send you the waiver, AND assumes that they'll send the reissued cheque. We could all be waiting forever, with Money Mart counting on some people giving up.

I was told that Cash credits are estimated to be less than half of what you got in Transaction credits. If you know your Transaction credits amount, you can estimate the cash payout.
