You may get some success with filing a complaint w/ TD. I know CIBC takes client complaints very seriously and give their agencies major (edited for language) if they get legitimate complaints (and if this was a CIBC account, you can bet iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency would get some).

As for the opening post question... if you have the receipt, here's the way to handle it.

Notify him, in writing, that you dispute owing this debt and, if the original creditor believes you owe it, you wish to have him sue you in court. It then becomes illegal for the collection agency to contact you. Some would say if they then list it at the bureau it could also be considered a collection attempt. I don't know for sure, but you should be able to delete it.

They won't for $200.00... but if they do, you can show the receipt to the judge and countersue for harassment, aggravation, and negligence.

Jamie... what agency do you work for? See... in Alberta at least, and I expect in other provinces as well, the government requires that unclaimed money be turned in to... you guessed it... the government!

They may not be interested in doing anything about the mistreatment of debtors, but I'll lay odds they stop down real quick on those companies that don't turn in the debt. I'm sure, if your agency does that, your local MLA would love to hear about it... :)

oh Lord.... So D&A called you for the same account? But the problem is you've ALREADY paid the account to iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency . My advise would be that you have to continue to deal with iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency and demand them to acknowledge the payment. Tell them if they don't you'll take court action against them (claim it back at small claim court) because they "stole" your money.

Now backtrack a little bit, you said you paid the account by a bank draft. Did you mail it to them by regular mail or registered mail? You said you would go to your bank and did you ask your bank if the cheque has been cahsed and by whom? Gather all these info and smack the heck out of iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency .

here is an update

i had a nice chat with the guy at CBLC .. i told him yet again that i can prove that i have paid .. he said that he will look in to this and call me back

about 20 mins later he called back and said

" ok i looked in to your file and it does not seem that you have paid

i am fed up with your b/s and i am fed up with you wasting my time .. if you have no intentions of paying then tell me now ! "

my reply to that was this

" 1) you have no right to talk to me or anyone else like that

2) as i said i can send you all the info you want to prove that i dont owe you anything

3) as for me wasting your time ...... thats a joke .. believe me i have alot better things to do with MY time other then talk to you

his reply to that was

" well ok then .. send in all the info that you want but we need it by 4pm today "

so i sent everything off YET again

and for a while i thought it was over ... no letters .. no phone call's :D:D

then yesterday .. i had a letter from D&A collection corp for the same damn thing ... ggguuuurrrrrr

and so it starts again

When collection agencies get your file, they don't usually do a credit bureau check on you unless it's over $1000 as it really isn't worth the money to them to run it.

As ranzzzz has said, the "credit investigation" is a bluff. The money you paid to iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency probably went unclaimed some how (in their office) and went to the "house -- any unclaimed money to files, the agency keeps as theirs).

What I find interesting, is how your agent doesn't want to investigate where the payment went. If you have a receipt to back the payment up, it's all you need to have the file closed.

What I would suggest, is call iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency and talk to your agent. When you get him on the line, request a letter of release from the agency. When he says "... you need to pay etc" tell the guy, you had and the proof was sent. You are willing to resend it, if they want -- but you want the release letter faxed to you by "4 PM" THAT day. If you don't have a fax machine, get the number for the machine at your bank branch. As it's regarding your account with them, they should give it to you, and allow you to use it.

Don't worry about it. Tell him you're gonna file a formal complain to consumer protection regarding his harrassment. Ignore with this "credit investigation" (I notice they really love to use the word "investigation. Too much CSI IMO) because you can simply dispute it with your receipt if they do anything to your credit report. For the payment, what method did you use? online banking? or bank draft? Double check with the bank to make sure it really went through first. If it did go through no problem, you can tell him either they acknowledge that $200 payment or you're gonna file a claim at Small Claim Court to get it back. That's it.

ok so here is whats going on

i owe TD $200 .. and i have no problem in paying it back .. i have been to the bank with money in hand but they wont take it due to my file has been passed on to CBLC ... i thought no big deal

so anyway .. i got a letter from CBLC some time ago telling me that i need to clear my account up and i am to phone them and give the ext ect ect

so i did and i got talking to some guy .. and he told me that i need to make a payment by 4pm that day ... so i said not a problem i will go do it now

so he give me an account number ect ect and told me to make sure that once i have made payment to fax the repciet to him so he can remove my file .... so i did everything he said ... and no problem i thought

so i got a phone call the other day ( SAME GUY ) tuesday
telling me that i need to clear up my $200 bill or i am going in to credit investigation .... ( AND I WILL END UP LOSING EVERYTHING ).. << so he says

so i told him i have payed it and i faxed off the repciet to you ... he said no you haven't ... ect ect ect

( now comes the fun bit )

we got to the point that again he said that i need to clear up this account by 4pm that day ... as i am 140+ days past something .. and the next step is the credit investigation .. so i asked him well where the hell did the $200 that i have already payed go ? .. and he said

i don't give a damn what you have payed or what you have said that you have payed .. right now in front of me i can see that you have never payed a penny on this account ... SO I CUT HIM OFF THERE

and said yes i have and i have the damn repciet to prove it

then he told me he didn't want to know about any repciet that i clame to have .. and that he wants this account payed off .. and he wants it payed off NOW !

so i told him that i don't have the money to REPAY it

and he said that i was wasting his time ... and that he is going to mark my file with i have no intention to pay and that he was going to go ahead with the credit investigation ... then he hung up

so from Tuesday - today ( Friday )
they have called 4 times in 3 days .. the last call was 2night at 8:12pm

i am at the point now that i don't even want to answer it

and they don't leave any messages lol

so what do you think i should do ?
