Be warned that the company in question has at least on one occasion moved the date of first default to the charge off date, to make it appear that the SOL still applies. I have also noticed that many people in different forums seem to have court orders granted against them without their knowledge; this is another slithery - illegal? - practice of theirs.

I asked someone on here they tend to agree with me, it would be the last time you made a payment on the account.

If may/2007 is the last time you made a payment on your account, the statue has not run out yet. I will double check for you and see if it’s from the time of repo or payment.

So just to confirm, the statute of limitations has now run out for them to come and sue me?

I believe it should go by the last time you made a payment on your car loan. If they call looking for money; I would not knowledge you owe the debt or put anything in writing. In doing so you might re-activate the statue of limitation by admitting you owe the debt. Once you know for sure that the statue of limitation has run out, and then you can admit over the phone you owe the debt. I would not put anything in writing.

Probably in either April 2007 or May 2007. I am not sure exactly but they repo'd it in July 2007. I must have been 2-3 months behind.

So the car company that repo'd my car in July 2007 has until July 2009 to sue me?
