They can and will sue you. Granted, WE won’t sue you right away. What WE will do is wait until your, say, $5000 has hit a grand total of $15000 in my office... then Ill take you to court for the 15 not the 5, you pay all the collection costs and court costs and my company walks away with an extra $10000. Its called a judgment people... look it up, read about it, its real and it ruins you for 21 years. You will get taken to court. You will be shown a copy of your contract with what ever company you didn’t pay. Case closed, pay up. With you little debtors who don’t think you will be garnished, think again. You don’t even need to be there for that to happen. As soon as your place of employment gets a phone call wanting to speak with your pay roll department, watch out.

Look out for those promise to appears in your mail and keep on debt’n!

I have a feeling that a certain bill collector missed his quota due to some educated people stating STATUE OF LIMITATIONS everytime he called, lol.

What a joke you are, like a said a coachroach bill collector. If it weren't for people owing money you wouldn't have a job loser. I bet you couldn't get a real job, so you decided to become a coachroach bill collector.

Why don’t you lazy losers just pay your bills and stop looking for loop holes out of debt. You Got your self into this mess, be an adult and figure it out for your selves. Making complaints about collectors doesn’t get them fired or erase your debt. It takes a long time to collect but does get collected and in the time it takes to get the complaint worked out, your account has been building interest and you owe more money.

Oh and further more. Collectors aren’t in the business of screwing people over. A lot of them are actually helping you out by offering you settlements on YOUR DEBTS that YOU signed a contract for. YOU were aware of the fees and interest going into it so suck it up. All day long I listen to you people try to weasel your way out of paying your bills and I'm sick of it. You are the reason the interest is so high on all your debt. If you paid your bills maybe I wouldn’t have such a high interest rate on my credit card or maybe I wouldn’t have to pay a $200 deposit when I got Hydro put in my house. Think about it. The "Debtor" theory is the exact same as the "shop lifter" theory. You steal, the prices go up.

so thank you guys for being such LOSERS!

For further reference, in Alberta, the existence of preagreed limitation periods has been a bit of a sticky and confusing point even among lawyers. Ontario ironed it out a long time ago but a statuory ammendment to the Alberta Limitations Act prohibiting such extensions, while it was drawn up in 2003, didn't come into force until April 1, 2006 as can be seen from the link above.

Obviously, our blogger's contract with the fertility clinic occurred prior to 2006, and so that's why I said he should try and get a copy of the original invoice just to be safe.

However, so as not to go into a lot of unnecessary detail, create confusion and because it was a relatively small amount, I simply advised the blogger to tell the collection agency to buzz off or settle for a small percentage if he chose to do so for moral reasons.

Have you pulled your credit report? Is the $150 (now $500) on there? SOL is Statue of Limitations, in otherwards, they can't sue you or from what I understand can't take you too court. So, they can't garnish your wages either (Raymond will know for sure).

First step, get your credit report from Equifax. Find out the last payment date if the item is actually on there. You said the debt was from about 5 years ago? Therefore, if the item is on your report, it will fall off in about a year. Honestly, no point in paying it now. They are grasping at straws, hoping you will pay it. They have no leg to stand on, and they definitely aren't going to go to court over $150, which is all a judge would grant them if they won.

If the collection agency calls again, say nothing other than to state that they are to only communicate via mail. Send them a registered letter also stating that communication is to be via mail only. Don't say anything else. If they phone, record the time and date and hang up. Just in case there is grounds for harrassment. If you get any letters from the collection agency......toss them in the garbage.
