If you are making payments faithfully then they have no right to call you.

Also, if you tell them on to call your work, legally they are not allowed to call your work.

They are not allowed to "harrass" people for more money, the only reason why he is doing that is b/c he wants to hit is monthly quota.

Third party collection agencies are the worst and they do things so illegally because they think other people are stupid.

They cannot garnish wages or take you to court if you "refuse" to pay more. They can only do that if you are not cooperative (which you are) and cannot garnish wages as there are regular payments being made

But yes, contact them and tell them to STOP calling your work, your wife at work and calling all together. You cannot afford more then $150/mth and that is what they will get. Or ask them to do a settlement if there is not that much owing on your balance!!.

If you are writting cheques, you can look online or print out a statment, but the collection agencies do not send out invoices or recepits.

screw consumer protection... file a small claims action!

How old are your kids?

Send him a registered letter telling him he is not to contact you at work, your kids at all - except to ask to speak to you, or your wife at work.

Record any harassing phone call... then, yeah, OK, file a claim... but go to small claims court too. The only way to stop these morons is to hit em where it hurts. In the wallet.

if you feel that John Agis is getting out of hand and harrassing you, record the phone calls when he calls and then present those to consumer protection...

You don't have a written agreement in place with John Agis or his collection agency.. You DO have an agreement in place with the original creditor.

you should consult your local Consumer Protection and get their opinion on this matter. You should NEVER feel harrassed by a collection agency.!!

I would first find out where this guy lives and pay him a visit with a baseball bat and a bicycle chain. That's for speaking to your kids for whatever reason.
Failing that, I would immediately contact the police to file a harassment charge.
I would then contact the better business bureau and file a complaint against the company and him personally. I have done this and the calls stopped right away.
You can file a report online, and it takes about 15 minutes.
I would prefer the baseball bat method, but that's just me.

I understand that you owe the money.. that's not the problem..

I am trying to get you to be in control of the situation... I want you to take the offense, and not feel that you're getting bashed by the collection agency.

Did you get his real name and contact Consumer Protection? That's step #1

I have no contract with TCR - my original debit was with Home Depot.

I even tried to consolidate with renewing a mortgage - using TCR's advise and contacts - - as I have been told many times - - - work with them and it will be alright - - - They wanted 12000.00 dollars for a fee - I told them thanks but NO THANKS - so we sent TCR 150.00 dollar cheques once a month - now John Agis wants more and is harassing me at work, my wife at work.

Please keep in mind, I do realize that I owe this money, and am really trying to pay it. However times are very tough and this guy is ruthless and very, very pompous when I speak with him.

your suggestions would really, really help right about now. Should I just igore him ......

Your children's names are irrelevant to the collection process, unless they're named on the debt which they probably aren't.

Who's the debt with?
Where did you agree in writing to pay Total Credit Recovery interest?
Who is the original creditor? Where is the contract that you signed to initiate the debt with this creditor?

Why are you paying Total Credit Recovery... why don't you pay the original creditor?

Please contact your local consumer protection and ask them if John Agis is licensed to collect in your province... If you don't have the correct spelling, call Total Credit Recovery and ask them for the correct spelling of his name so you can check him out with consumer protection...

BTW... if John Agis is not licensed in your province to collect, he's been working outside of the Collection Agency Act and that could get Total Credit Recovery in serious trouble.

has anyone ever dealt with John Agis (sp?) from TCR?

I need to know more about what he can and cannot do - he has documented logs of my childrens names and calls the house and speaks to my kids like he's their best friend -

We have tried to rectify the status of our account, however he wants more and states that our payments are not even covering the interset...???

owing approx. 2900 - we pay them 150/ month - now he wants more.... can he do this and harass my family?????? We just don't have that kind of available cash....

TCR has never sent us any reciepts or at what interest rate they are charging us.
