I thought I answered that issue in saying there's lots of stuff on credit reports that's wrong and it's up to you to dispute what's incorrect. Monty, in telling you that there's no Consumer Repoting Act in New Brunswick is misleading you. I'm not going to type it out all over again. Financial institutions are governed by both federal and provincial compliance laws as you will see by reading this. PLEASE STUDY ALL OF THIS FIRST BEFORE ASKING ANY MORE QUESTIONS!

See this is the thing...I never acknowleged the debt. I never send them anything in writing (including proof of payment) so how can they update it 2 years after the paid date and right at the end of the 6 year SOL?

6 years.after the cause of action (i.e. default)
arose.

See Chapter 133, Sections, 8, 9 10 of the latest version of the Limitations Act of New Brunswick. Note also how a limitation period there can be renewed whether or not a promise to pay the debt can be inferred from it, although it must still be in writing. That's why I tell people: Stick with the telephone.

Man, what a lot of verbal hooey in that Act1!! Let's hope a plain language one is on the way soon.

I don't know what the SOL is off the top...

The best place to call is Consumer Protection in New Brunswick.. or what ever the office is called..

It will be the office that regulates the Statutes of Limitations Act, or what ever it is called in your province.

From what i know, in ontatio we have the 2 year limit. But that was put into effect only a few years ago, and thus any charges before the date the law was put into effect, still hold to the old time frame. If you pay just 1penny the time gets reset.

How ever if it is about a dept owed to any form of the government, they can call you forever till you pay, there is no limit on it, such as credit. (be it 6 years or 2 years or whatever)

if they have your information thats not because of private listing but from whom ever you incurred the dept from, being a credit company or the government, so there really isn't anything you could do about that.

However from what you say, they are breaking the law, they should not call you in such frequency as to harass you.

We have just had the honour(?) of dealing with iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency about a supposed debt that was incurred 6 years ago. It would be in everyone's best interests in investigate your "Statute of Limitations" when it comes to collecting for a past debt. I would like to mention that this debt never existed. In Alberta if the collector has not contacted you within 2 years of the incurred debt then they cannot collect it. This company told us the debt was incurred 6 years ago and continued to harass us with phone calls. Also, we have an unlisted, unpublished private phone number and they managed to get it some how. We confronted them asking how they got our phone number and we were told it was in the phone book (this is not so and I checked with the phone company as well). We spoke with them with respect to the statute of limitations and the apparent debt and that we would be seeking legal action if the harassment did not end. We also said that we would report them to the CRTC for illegally obtaining our phone number. As this time we were told that there would be no further phone calls and should we receive any that we are to refer them back to the company.
Also note that they would not provide any backup information regarding this debt and refused to answer us as to why, if the debt is 6 years old, that it isn't on our Credit Bureau information. The only response we received was that if we didn't pay that they would be submitting it to them.

Please ensure that you know all of your rights and laws regarding collections before you deal directly with these people.
They will also start calling from other areas of the country from different phone numbers in order to harass you further.
