Also... again, this may depend on where you live... but "late fees" are no longer legal. TransCanada Credit informed me of that detail years ago when they had my car loan.

Actually, they were really quite forthcoming about what my rights were. Probably the only place I've ever dealt with that was...

Depends on what you mean by "service charges" and "late fees." The creditor can claim both prejudgement and postjudgement interest, court filing fees and legal/paralegal fees up to 7.5% of the amount being claimed. There may be some variation on the last amount depending on where you live.

You're paying LATE FEES and SERVICE CHARGES???? To the collection agency?????

What province do you live in? Cause in most provinces that is highly illegal. They are not allowed to collect anything from you except the debt... the sole exception being NSF fees.

Sounds to me like you have a GOOOD case for harassment litigation as well as for them breaking countless laws.

Nail them to the wall.

(PS... my law suit's still in the process... Queen's court. I'll let ya know when it's all filed. Barstids are gonna pay my mortgage for me.)...:)

That's an interesting point...
I can't imagine collection agents making house calls.

That would be totally inefficient for most of them. However, in some cases it might be profitable for them..

I haven't heard of too many collection agencies making house calls.

I do remember that when I worked at Household Finance, in 1985, we made house calls to repossess TV's and such that were purchased on Household finance's consumer credit.

That was pretty scary and uncomfortable.

One of the reasons that collection agents don't like to make housecalls.

The link below describes the statutes that belong to the Collections Act of Ontario, describing what collection agent activities are legal. I posted the Ontario one because it contains about 40% of Canada's population; however, the ones across the country are pretty similar.

I mention this because I told blogger "Scottydog", something that wasn't quite right. I said that collection agents are not allowed to make house calls anymore. I got this info from lawyers' legal glosses and I hadn't actually heard of collection agents making them for many years. It's also become more a less a moot point for some pretty obvious reasons - like the one pictured on the left. Still, I shouldn't have assumed anything; and after checking with the Ministry and the legislation, apparently housecalls are allowed. In fact, you can see by Section 22(6)1 that the Act uses the phrase "personal call", as a variant or form of "contact." And so just because it's rarely used doesn't mean that it's become illegal.

Nonetheless, this may even be a good thing for homedwellers like "Scottydog." as it would allow for some "interesting" responses.

You never can tell who might come to the door if collectors like Global's Deanna Natale started sending out her minion to make housecalls.

When saying I would 'punch her in the face', I am speaking as you and not as me.
I'm a little crazy, but not a lot crazy, and collection agent or not, I could not bring myself to hit a woman.
But women hiting women is funny, so scratch her eyes out will ya???

I would not only NOT give them anymore cheques, but if that woman comes back to your doorstep, I would punch her right in the face!!! NO ONE HAS THE RIGHT TO COME TO YOUR DOOR AND DEMAND MONEY!!!!
I would not only beat the snot out of her, but I would leave her laying on the front porch and call 911 to report trespassing. Then I would sue the company that employs this woman for harrasment.

You seriously need to stand up for yourself in this matter and stop being the victim.
