Agreed. With balances that small, there's not too much to worry about.

Thank you for your advice TJ.

It certainly calmed me down quite a lot. I called and left a message informing them that I still wasn't working and was going to try and make small payments of $20 or so and would contact them in 2 weeks for an update.

I don't care if it takes me 3 years of paying $20 every 2 weeks or so, it's only $500 so I'll try and not stress about it too much.

:) Thanks again

First off...no they can not garnish his wage for your debt.
Yes they could sue you but for the amount you indicate, very unlikely as it would cost them more to sue then its worth....and even if they got a judgment....you personally would have no means to pay it.
If you have no assests such as own the house or own a relatively new car outright you are basically judgment proof until such time as your circumstances improve.
It is their job to bully you to get money and earn a commission...ignore them and pay what you can when you can.
The joint account would only come in to play if they sued and obtained a judgment....then yes they could garnish the account as your name is on it....so for now remove yourself from the account.

unemployed and owing balance

Postby Nani0115 » Fri Jan 11, 2013 03:16:13 AM

Hi everyone,

I am new to the site and have been reading through many many posts and threads for the past 7 hours.

I am in the same or similar situation as most of you and so am seeking advice and support on this forum.

Bit of background info.
I have been unemployed for almost 2 years now-coming up on 2 years this April...I was on EI but have been off of it for over a year now. (As I received it for 7 months)
We have been having financial difficulty and my husbands hours were reduced back in the fall time.
I fell back on my canadian tire cred card payment in 2012 and was sent to collections. We are now dealing with TCR-total credit recovery-the one located in BC.
I spoke to the branch manager Katy Albrecht and then was sent to her employee/assistant/agent..I can't remember her name ATM. Anyways, back in Dec. we worked out a payment plan..it was supposed to be $50 on a biweekly basis-unfortunately during the winter season I was only able to make 1 payment of $20, I feel bad but we seriously were counting pennies and still are.

I did not plan to only pay them $20 and since I hadn't planned it, I actually thought we could increase the amount-I told them I'd be open to renegotiating the payment amounts dependent on income status..I shared with them this as I didn't see it as running away and just want a flexible payment schedule...anyways....now it's Jan 11 and I was supposed to call them on Jan 7th and have just been having mental breakdowns what with the overwhelming xmas season and sucky jobless time, life etc.

I was wondering-only my husband is working right now-could they garnish his wages for my debt?
He didn't cosign or anything like that. Can I be sued? My balance owing is like $520, I would love a job right now and just get them off my back but it's a major depressive mental state when one has been out of work for a long time.. My husband and I have a joint account.....does that matter? He only makes like $900 and some odd and if he works 80 hours. Most of the time he doesn't..he works in landscaping...

He has also gotten into the red with his canadian tire credit card too and thought I don't know who/which conpany is now handling his case-could they garnish his wages/take to court? He owes between $300-$400.

Katy A. called last night for the upteenth time and said that we can call her before 9am Friday morning before it escalates further....she's said this before..the problem is I don't knwo if it is meant for me or for my husband...

so frustrating....I so envy rich people...and people who are not with debt.

Thanks everyone!
