You need to go to the small claims court to file the defense.
By doing this you will also verify that this is an actual claim. Can not be done online.The document you were served will say which court it was filed at. You have 20 days from when you were served to file.

how do you file? I cant get time off work to get to court house, can you file on line or something?

What kind of paper work do I need to get from them, they have asked for a payment before month end, I was served papers at work on the 29th of november.

yes...still file so there is no chance of them winning a default judgment.
Do not trust them to cancel case....I repeat do not trust them. Be sure you have all arrangments in writing and signed by someone in authority at CRS before you pay a dime.

What if I spoke to them and offered to make payments, she said she would send me papers to sign. Do i still need to file?

A claim does not have to be made through a law firm.
Assuming this is a legit form and not marked anywhere Draft, then they have filed prior to the end of the 2 yr SOL.

You can try to negotiate now or wait till the pre trial conference, or wait for a judge to decide the payments.

What ever you plan to use for a defense make sure it is done within 20 days.

CRS Question

I was served a Plaintiff's claim from the CRS, not any law firm.

It is Form 7A and has a hand written claim number starting SC-12-xxxx-00. There is a blurry stamp "Ontario Superior Court of Justice" on the left corner. There is no clerk signature on the stamp but on the last page.

My last payment recorded on both equifax and trans is oct 2010.

The date that is stamped on the claim form is July 25, 2012 but I was not served until last week.

Is this a real document seeing you can print them off and fill in the info yourself and the stamp is just a normal stamp. The signatures are from CRS, it states that any extra info should be attatched to the back but there is nothing.

could this just be a ploy to scare me into making a payment, I called them and spoke to them and even made them a lump sum offer but they are asking for more than I can give so she suggested making payments and said she would send met he papers to sign to stop court proceedings.

Do i have any options?
