Let me rephrase my last comment.
The sol starts when the bank realized or should have realized that the overdraft was in default.
So a mth or so after it should have been paid.
The clock starts then and runs 2 years.

Yes Alberta's SOL.

Which is 2yrs from date of last activity.
Once the SOL has expired it can not be restarted.

Since the overdraft occurred in Alta does the statute of limitations come from Alta? I am not sure exactly what month it was put into collections as I was just notified about it yesterday, my ex claimed bankruptcy Nov 2006 and was cleared the following Mayish. What is ridiculous is that this is all for 697.00

This agency bought this account for pennies on the dollar and now all they can do is hound. They have no legal recourse now. Thats how they make their money....bullying people to pay at least something and make a profit on their investment in these old accounts.
Ignore them....sooner or later they give up and sell the account to another bottom feeder.

Yes it was a joint account. I got my equifax today and it is still fine. So I think I will just ride it out and not take their calls. Thanks for the advice.

I assume the debt you are speaking of is the overdraft on the joint account.
Since this debt is as old as you say the Statute of Limitations has run out and the courts can no longer be used to collect it. Also if it was over 6 years ago it would have come off your credit report by now. I would suggest you get a copy of your Equifax and Transunion report to confirm this.
You can simply ignore the collection agency...they are simply trying to intimidate you to pay a debt they bought from bank long ago.
Just be sure not to have any money in any branch of that bank as they can seize it using their right to setoff without a court order.

I co-signed for a bank account for my ex-husband in Alberta. I left the marriage and we sold the matrimonial home. He was to close the account upon the sale of the home, this was not done. I moved to BC he continued to use the account went into arrears and then claimed bankruptcy. This was 6 years ago. I was just contacted by a creditor stating that this debt of overdraft is now mine. My credit rating is now tanked I assume even though I did not even know of the debt. Is there any point in paying the debt now or should I just refuse to pay. Will my credit be marred each year or is it a one time mark on it?
