I thought you meant "discharged" when you said you were "cleared." in Feb. of 2007.

I guess it's a different ball game out there now compared to 15 years ago with bankruptcies. You're more attractive to some creditors than if you were saddled with a consumer proposal or a bunch of R9's. Creditors don't have to worry about other competitors for your payments.

Nordon will try to bluff you if they can, but it's all a moot point whether or not it was included on your bankruptcy, as the 6 year limitation rule would apply in Ontario both for Nordon to start legal action and for it to be included on your credit report.

However, you may want to clear it up for moral reasons as opposed to reasons of legal necessity.

My bankruptcy trustee said now that I have been discharged they have no files. Because I did not know of the debt at the time the trustee never knew about it.

It took 3 years due to the 9 months and the 2 years to get discharged enough to get creditors to look at you. I started getting credit the day my 1st 9 months was up. I bought some furniture then a car and carried the loans for 9 months at a time and paid them off. Bought a car and paid it off in a year 1/2. Yes it will be on file for 7 years but banks and other creditors will look at you if you do like I done as your credit score will rise quick.

You need to contact your bankruptcy trustee. That Nordon debt should have been listed with your other creditors when you filed, assuming it was an item eligible to discharged under bankruptcy and your discharge was absolute.

How come it took you 3 years to get discharged? It's usually about 9 months for a first bankruptcy unless you're waiting for student loans to age enough to be eligible. And how can you build your credit so soon after? Your discharge will be on your credit file for 7 years if it's a first bankruptcy.

COLLECTION ON REPORT AFTER BANKRUPTCY

Postby moving-on » Fri Apr 13, 2007 12:00:00 AM

I used to live in Ontario about 7-9 years ago. I have since moved to Nova Scotia. I claimed bankruptcy 3 years ago and been cleared in Feb 2007. I had started to re-establish my credit and went for a pre-approval last month. There was a collection on there from Nordon collection for $1700. This was for a debt from marriage that I have since ended 6 years ago. My name is on the debt and I am wondering what I do and if I am still responsible. This debt is from my time in Ontario and long before I claimed bankruptcy. Any help would be appreciated.

Thank you
