Go back to the court where claim was filed and file a motion to have judgement reversed because you were not legally served. They will have copys of proof of service. Who ever is claiming they served you would have to have sworn to that effect. See when and where and if you were somewhere else at the time. The default occurred when you did not respond in the alotted 20 days. Had you been served you would have needed to file a statement of defence within 20 days.

Hi;

Thanks for your reply.

Did not receive a statement of claim that I am aware of and no notice of trial date.

Either way I still got a default judgement in a legal doc with claim #.

Thanks

Did you receive a statement of claim indicating you were being sued, and or a notice of a trial date?

Default Judgement

Postby Jed2get » Thu May 31, 2012 02:26:16 PM

I got a default judgement against my small 1 person company.

It was filed on behalf of a large Plaintiff from an outside representative.
It is not clear what the Plaintiff is suing for as there is no back up docs only an amount and I

do not believe I was served a notice of default?
What are my rights and what should I do?

What if i do nothing as I am an Incorporated?

Thanks
