Basicly what they can say is most of the time dictated by the creditor, but they can say what ever so long as they stay in he grey and dont divulge and info on the account or personal info.

Thank you for replying TJ.brooks. I didn't want to reveal too much information incase the agency is eyeing this site. This debt is fairly new. Honestly, I don't have the money and I have also been procrastinating. I have received letters that I have to pay in full. They also gave me a deadline or I would be sue. I don't think my old heart can take a lawsuit at this time. I have thought about sending a cease and desist letter. However, I'm afraid this will speed up a lawsuit. This is actually the second agency that my account has been passed on to. The first agency didn't leave such detail messages. I don't mind them leaving such detail messages if I was living alone. However, I live in a housing for seniors. We all share a phone and answering machine. Nothing is private here. I thought there might be some privacy laws on my side.

Usually the line is we have an important business matter to discuss with you.
There is no law that says you ever have to talk to a collection agent.
What kind of debt is it and when did you last make a payment or acknowledge the debt in writing and signed?

If it has been 2 years or more then they can not win a lawsuit as the Statute of Limitations will prevent them from prevailing. It is simply an empty threat to intimidate you to send money.

We would need a little more detailed info to give you any further advise.

How much info can debt collectors leave on your answering machine?

Postby Dazed&Confused » Thu May 17, 2012 12:53:34 AM

Hello,

Does anyone know how much information a debt agency can leave on your answering machine? I have a credit card debt that has gone bad. For the past 5 weeks a debt collector has been calling my house. I have not spoken or had any contact with them ever. The messages usually goes something like this.

Hello, This message is for ____. This is (collector's name) from (debt agency). I'm calling on behalf of ____. I have your account on my desk which I need to resolve as quickly as possible. I haven't been able to speak with you. It seems you have been avoiding my calls. You need to come up with a solution to satisfy my client. According to the contract agreement you have with ____ we can proceed with legal procedure if you refuse to resolve this. You can make a voluntary offer or I can discuss this financially with you. My number is ____.

Are they allow to reveal this much details? Is this the normal?

Thank you.
