Regardless as to what personal arrangement you and your ex may have come to regarding who pays what....the fact remains that it is your ex that has the contracts with the creditors...not you.
In the event you fail for what ever reason to keep up the payments...it is him they go after not you.
The credit file reflects his true credit history, and will not reflect some private arrangement you have made between yourselves.
If infact the debts are owned by both of you on paper then they will come after both.

You can not just arbitrarily re assign a court judgement or any other legal debt for that matter.

In a short answer............NOTHING HAPPENS.

While you and your ex-husband may have agreed in a separation agreement that you will assume all the debts, the creditor(s) were NOT a signatory to the agreement, therefore they are not bound by any agreement.

Any further contact with any of the creditors and/or credit reporting agencies is a colossal waste of time.

Divorce - and transfer of debt

Postby freedom » Thu Nov 17, 2011 05:49:38 AM

my husband and I agreed on who takes what debt after our separation.....

I take all the debt and I get to keep the house.

How do we get the debts removed from my ex's credit file - if I am now the owner of the debt....will a letter from a lawyer be enough to keep the creditors happy?? One is a judgement.

thanks in advance to anyone that can offer help.
