Does Credit Report Identity Verification reset the Statute of Limitations

Postby holdenc » Mon Oct 03, 2011 11:50:17 PM

I apologize if this is a silly newbie question, but I'm going to go ahead and ask.

I have a delinquent Visa debt from RBC from 10 years ago that I would like to finally resolve. I wasn't even sure how to go about doing this, as I haven't been contacted about the debt since 2002. So I started doing some online research (which lead me here) and I was going to pull my credit profile until I was recently informed of the Statute of Limitations here in BC. As such I understand that the debt may no longer be collectible, as the last activity would have been early 2002. I also understand that it may not even be on my credit report... or at the very least there may be a more financially reasonable way to settle this debt based on the age of it.

My concern is that by inquiring about it (i.e. requesting my credit profile and verifying my id), that I may inadvertently reset the statute of limitations. Can anyone tell me if requesting my credit profile from TransUnion or Equifax, and providing them identity verification on the phone would effectively acknowledge the debt?

For example, when I submitted my request online to TransUnion, I was informed they couldn't verify my identity and instructed me to call them. I did so, and when they asked me to verify my identification, they asked me to confirm the financial institution that I had any bank accounts and credit cards with in the past. I wasn't sure if confirming RBC and/or the RBC Visa would effectively acknowledge the debt and reset the statute of limitations back to zero, so I claimed not to remember the institution. I'm not trying to avoid repayment, but if the debt is now stats barred, I figure I may be in a better position to negotiate a reasonable settlement. But I fear divulging too much information to the credit bureaus may effectively reset the limitation.

I apologize if this is a silly question. If anyone has any feedback or guidance, it would be greatly appreciated.

Sincerely,
Confused in BC...
