You have to pay for this document Cease & Desist Letter? can't do that no monies. Just hung up from these ICE jerks again..

I had a thought and wondered if anyone had any input.

Okay, i'm hoping that people all ready know that they are registered at birth as a corporation and so later on down the road if they want to run a business under their own name they don't have to register it. That would make it confusing for the minions that do the bankers dirty work. It's a scam, i know, however, perhaps we can use that in our favor?
Let's say you work a job during the day but decide in your off hours to have your own business under your own name and unregistered.
Lawyers do this all the time...charge for every phone call.
If a collection agency calls you tell them that you are giving them fair warning. That you charge so much for picking up the phone to unsolicited callers after the fair warning notice is given once and do record it. It's important here, before you say this that you get their company name and be sure you can get their address either from them or online. Tell them you work from home and charge so much for the calls after the fair warning. A flat fee would be given...say 200.00 and that they will have accepted your terms if they call again. Make note of the time and day and record it all.
Tell them you will charge them so much for every minute on the phone and that a flat rate of ...say...50 dollars applies after the first 15 seconds.
You are within your power to invoice them. You can create an invoice on the computer. Express Invoice is a good one. You can send them an invoice for every time they call you or send you a letter. You are entitled to charge whatever you like. The more they say you owe them the more you should charge. If they don't pay you can go and with some simple paperwork create a lien on them where they won't be able to conduct (credit) business until that lien is satisfied. You could possibly get them owing you more than you owe them if they do not desist. I haven't actually tried this with a collection agency but i did with a telemarketer that told me i signed up for something online. They called me six times in one day...all different people. I told them I would invoice them for my time and that they were under contract with me via my fair warning notice if anyone in their office called me again and that i would lien them if they didn't pay what i quoted them. They never called me again. Any thought boys and girls? And do invoice and send them out. Declare them on your taxes.

Go here and D/L my Cease and Desist template. Modify it to your situation, then update the first line to read: "Pursuant to my rights under ONTARIO REGULATION 103/06," as the act was updated a while back. Once complete, fax it over to their office and save the Transmission Confirmation sheet in case you need it in the future.

Thank-you..also..after I talked to the jerk today they have called twice more..I did not answer..how can I stop them from calling more than 3 times a week?

As long as you do not have any money at whatever institution issued the card they can not touch it.

THANK-YOu for your response..but my bank account is with TD NOT MBNA
and it was more like a credit card..does this make a difference? And all I get a month is CPP and they cannot touch that by law.

When I say they can sieze it I mean the bank...not the collection agency.

Just be sure you do not have any money in an account at the bank that issued the card...else they can sieze it without court order if your name is on bank account...they cannot remove from your husbands.

Tis true...regarless that it is Statute barred does not mean you still do not owe the money. All it means as they have no means to collect except to hound.
So when they say they will do anything and everything...there is nothing.

ok I called these yahoos today..he said that it does not matter that it is Stats Barred..I still owe the money..and he said they will do anything to get the monies..HA HA..the JERK hung up on me when I said I had to go..idiot.
I also told him that my husband does not know about this debt and to stop sending me mail with their name on the envelope..he said oh there is nothing we can do about that..I told him that I would then put "return to sender" on the envelope..he said that was my choice. ICE is a 3rd. party for my MBNA debt.
