contact BPCPA website and launch a formal complaint. Ensure you contact the person trying to collect against your family member and if it is a collection agency, you can sue them personally as well as the agency! Shame on them !

Trust me they wont stop.. they swap callers, use different numbers.. even send your file to different provincial offices they have set up. They are relentless to the uninformed and will drive you crazy.. I know.. they did it to me.. They call sometimes three times a day, weeks on end.. and even when you propose a payment schedule they push.. and if you get nasty with them..

But there is away..

Then I found out how to stopped them dead in their tracks.. without so much as a phone call.. guaranteed.

Send a copy of the deceased family member's death certificate to whichever company it is that keeps calling you, along with a note requesting calls to stop to the phone number that they are calling.

Thanks - I hope to finally get some relief from a really bad experience with these people.

I would address it to Mgr. of the collections dept.
If you do not know their name...MANAGER in bold letters should suffice.

Thanks for the advice - I intend to follow through. I'd like to get a specific name to direct my registered letter to. I know it's proof of delivery, but my experience with these people is that they're unethical, and the letter could end up anywhere in their outfit. Any suggestions on identifying someone or some department within CRS that I can direct my correspondence to?

Ffile a harrasment complaint with the police ...also write them a registered letter to cease and dissist....and advise them if they continue you will take your own legal actions. You are not responsible for anyones debt...unless of course you co-signed.
I would also record any calls you continue to have so you will be able to produce them when needed.

help please re deceased family member's debt and harassing CRS calls

Postby lookingforadvice » Wed Sep 28, 2011 01:44:40 PM

I have been receiving calls from CRS for at least 3 years re a deceased family member's Canadian Tire Debt. The woman who keeps calling has threatened me many times, such as a particularly memorable Christmas Eve call when she said someone was coming to assess the property and start legal proceedings. I know they can't do this, but the 'tactics' are rotten.

For several months, beside the daily messages, I've been getting calls that are just a recording of a very annoying and loud repeating 'tone'. I realize these people use very low tactics, but my health is already compromised, and it's really starting to affect me. Sometimes they use the "noise" tactic in back to back calls. Is this legal, even for Collection Agencies? They have also used a name when calling about this account that was never associated with any of my late family member's accounts (it's a maiden name), and I believe they obtained it fraudulently.

So, my questions are: what are my rights with respect to what these people are doing, and if I write to them re the possibility of contacting the police regarding the alternate name they use with this account, as I have been advised I could do - do you think that will generate any change in this situation?

thank you.
