If your debts are general consumer debts (not including student loans and other government type debts), because the date of last activity on the accounts was more than 6 years ago, they will have been stats barred in any province. That just means they can't legally file a court action against you. It doesn't mean they can't legally hound you until hell freezes over about them though.

You should note that sometimes agencies will try to sneak a claim that's stats barred through court and try to get a default judgement if the debtor doesn't show up. This is more common in the US than in Canada. Should you ever get a statement of claim served on you, it would be wise for you to reply to it and use the statute of limitations as a defence. Most collection agencies will try to bluff you.

To get rid of the nuisance calls from iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency , simply use "the Jackson Method," referred to in other posts. When iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency called me a couple of months ago, it took me less than 1 hour to get rid of them. No offense, but anyone who would put up with that for 5 years, well.......

Creditors can "DISCLOSE" your personal information to collection agencies as a matter of the collection procedure, as stated in PIPEDA which is located on PIPEDA

Collection Agencies can only "Collect" your personal information by the federal privacy commission regulation. However, nothing in PIPEDA says that a collection agency can DISCLOSE your personal information to a third party, Credit Bureau, without your written permission.

You need to ask the credit bureau where you gave them written permission to disclose your personal information to the credit bureaus.

If they don't provide you a copy of your written permission, you need to complain to the Privacy Commission in writing.

Let's see if she comes back with a defence...

Laura, I am beginning to worry about you. Julie Ashton (or whatever her real name is) made all 4 of her submissions yesterday to this site, naming liason people (ostensibly in iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency ) to 4 individuals having problems with iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency . So, yes, she probably does work for iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency and is likely someone who came on this forum to reduce the bad press that iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency was getting on it and thus on the Google links. If you don't believe the latter possibility, type in someone like "Deanna Natale" or "Natale Law Offices" and see what gets Googled.

For example, here is what a desperate blogger, Beverly Corbett submitted 3 days ago on March 6:
-----------------------------------------------------------------------------------------------------------------------------------
I have two student loans that have been both sent to collection agencies( iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency and A.R.C Accounts Recovery). A.R.C are constantly phoning me and asking for a lump sum payment of which I cannot afford. They will not accept payments and are therefore going to sue me and charge me the expense. I would like to know is there anything I can do to avoid being sued?

---------------------------------------------------------------------------------------------------------------------------------------
And this was the response by kind, understanding, helpful Julie Ashton:
---------------------------------------------------------------------------------------------------------------------------------------
All you need to do is send a series of post dated checks for any amount and they will not call you. Your file will be put in a post dated check queue and each month the payments will be posted to your account. When you know that they are running out send some more checks before they call.
--------------------------------------------------------------------------------------------------------------------------------------

Er right! Get it? It's a trick, damn it! That's why my letter to Julie was so facetious. iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency and other agencies have a whole bag of of them to sucker students. Go visit some of the forums that specialize in student loans like "canadastudentloans.ca" or the "canadianfinancialwellnessgroup.ca." and read the horror stories. That's why I told Corbett that she needed to get help fast from a place like the latter BEFORE doing anything. I hope she did.

With respect to your conjecture about getting help with stats barred debt and thus credit repair from iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency , well, that would be like asking a fox to guard your chicken coup. That's why places like iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency and Natale Law Offices buy up these stats barred debts for almost nothing and then work the numbers by bluffing people. We've only said this about a gazillion times. Now, you're proposing to get help from these scavengers of human misfortune?

Hopefully, Julie Ashton will return to tell me what a knucklehead I am and straighten me out. We shall see.

Sorry to bother you again, Julie. Look, if the debt is 13 years old and stats barred and iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency knows full well that it's stats barred, why are they trying to collect on it and blackmail the girl by sending in hard inquiries to the CRA's? Just wondering.

Contact Joy Meunier in Client Services she handles the TD accounts. If the account is stat barred then she can send a request to Equifax to have it removed from the bureau.

credit bureau inquries

Postby dd3408 » Tue Mar 06, 2007 12:00:00 AM

I've got quite a situation on my hand here and need some advice.

I have had 2 collection agencies ( iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency and D&A Collections) make inquries to my Equifax credit bureau in the past few months for a very old debt with TD. I know it is statute-barred and that it is not reporting on my credit bureau. This debt is over 13 years old but is in excess of 10000$ so I can see why the companies would want to try to collect on it. I managed to evade collection agencies for years until the debt became statute-barred and have since rebuilt my credit. When the first company, D&A, started to try to collect, they started calling me at work without even sending a letter. I put some heat on them by contacting Equifax and sending them some e-mails to the point where their efforts stopped. Now I have iQor, Inc formerly CBCL - Canadian Bonded Credit Limited - Now Iqor Collection Agency that has sent me an letter, offering to settle the debt for just over half the amount owing.

How can I get the to stop this or will it continue forever? Do these companies have the right to make inquiries to my bureau? Who should I address my complaint to? I don't want it to be with TD or the collection agencies as I don't want to confirm the validity of the debt.

Thanks,

D
