Hi Laura and Monty,

I wish I would have come on this site before that day all of this happened! However, the Government dealing with OSAP old or new say they can hold back Income tax from people. That is what they were doing...I almost told them to take it, but with my small income I rely on that, as well, GST payments every three months that they would have also taken.

That being said, they Canadian Bonded, told me it takes up to a week now for my Income tax to be released. With this information, from you, if I don't see that money in my account I will try to get this credit card money back. It is unreal now to think about how I didn't sign anything with them yet signed over that money through my Bank! The Ombudsman has not gotten back to me yet.

That's a great idea. I'm not really sure.

You probably could call the credit card company and do a charge back, especially since there probably wasn't an "in person" signature to authorize the payment.

You can usually charge back items for up to 12 months.

That is a really great idea.

As well, using a credit card to pay for a debt isn't really something a collector should be asking for. Stealing from one debt to pay for another debt. Debt should be paid out of cash flow, not debt.

You probably could call the credit card company and do a charge back, especially since there probably wasn't an "in person" signature to authorize the payment.

Can she not call the Credit Card company to cancel it? Say it was under duress & mis information? I thought there is a law of purchases (using the card is a purchase) for a "cooling down" period of up to 3 days, Call the collection company and tell them she's investigating and looking for her contract and all her medical notes.

Hey Fran,

This is a learning curve for most people.

I'm trying to help people get in control of their situations with collection agencies. It's perfectly ok to tell teh collection agent that you need to look at the contract first before you have any dealings with them. They should reasonable expect to wait.

The collection agency is trying to work on surprise and guilt.

If you don't have a copy of the contract, you should take the time to order the contract and have reasonable time to review it before making any decisions of any kind.

I bet that if you don't have the contract, you don't really remember the terms of what you signed up for. Thus it's hard to settle the debt with confidence if you aren't sure of the terms you agreed to.

People should always feel comfortable to tell a collection agency to wait while you get the details straight in their heads and make a payment.

Thanks, but I only signed for a Student Loan in 1993 at a Bank. I have no documents from any collection agencies signed. In fact they didn't even send me an updated report on how much I owed in writing. Ten years ago I had documents or medical forms, as I said before, filled out and they said were never received! Yesterday I was caught off guard and was overwhelmed with that woman's attitude about calling my Bank and asking them to increase my card. I still am not certain that is legal and I was stupid to be dealing with her in that state of mind.

What I'm trying to do is encourage people to NOT guess and to actually look at the contract they signed. The more you guess, the more power you give to the collection agencies in Canada.

You can order your credit reports for Free by mailing in your request to Equifax Canada and/or TransUnion Canada. Or you can pay for your credit reports on their websites.

Then you should pay OSAP the money. Check your agreement with OSAP and see if it allows them to use a third party collection agency. Look for something like "we may transfer our rights to a third party" along those lines.

*****How do I do that? Plus why would they when my Bank Statement shows the amount/date and Payee? Now you are scaring me!

Go to www.equifax.ca and order your profile instantly. it will cost you $22.00. If you pay a collection agency money, then that proves that you owe the collection agent money. When in fact you only owe OSAP the money. Collection agencies can only make an inquire on your file but cannot report unless a payment has been made. Cuz right now the collection agency can't prove that you owe them anything. They can only prove that you owe OSAP the money.
