Here's a career opportunity to fertilize the home lawn of Total Credit Recovery owner (Probably, George Krieser's place).

Not too sure why he's going through his company. All you need to do is pass a CPIC check and have lots of references to spread the manure, rake the leaves and go for groceries.

So, get a written agreement stating the payments, dates, etc.

Or else, I let it go to small claims court and work out a plan through that.

Just want to deal with it.

My goodness! 500 bucks every 2 weeks! Some bargain! Probably more than you would have paid had they gone after you in court. TCR isn't really into negotiations. (Why should they be when George Krieser can get the full amount so easily otherwise?) His minions are into bamboozling, lying, inflating bills, cheating and flaunting the law with impunity. Getting a debt settler would be an absolute waste of time and money. Besides, they're all recycled collection agents.

I hope you get a clear, signed, written settlement agreement from them before you give them a penny or I can guarantee you'll end up like "ergergerg" with FDR

So I talked with them, and we are close to a plan of $500 every two weeks. If I start paying them, does that change things? Otherwise, I will be looking for a debt settlement company.

The only question I have is one of personal information. When I talked with them today, they knew about a 5K loan I had taken out a year and a half alone and which is half paid off. They wanted me to refinance and pay them with that.

Is it legal that they were able to get that information? And ammo I can get to use against them would be appreciated.

I can appreciate your feelings about TCR. Even some ex-employees feel the same way. But, realistically, no one declares bankruptcy over $4K.

Still, it's enough to warrant legal action, and credit card interest will keep building up. If they sneak in a default judgment because you didn't defend it, the pre and post judgment interest though could eventually warrant bankrutcy.

TCR is required to keep a log of all calls. Besides, better to blackmail you with. I wouldn't worry about that. If the debtor doesn't have clear title to a vehicle over $5K (I'm not sure if it's gone up) they can't get the sheriff/bailiff to seize it. For example, there might be an outstanding loan (lien) or another party might have a partial interest in it. Certain tools of the trade are exempt from seizure in bankruptcy. However, if it's a matter of taking an asset over a defaulted judgment, you could lose it unless you share or transfer title.

But vehicles are not what creditors seek out first unless it involves a loan on it because the creditor has to put up a sizable bond of over $1000 in addition to other recovery, storage and disposal expenses. They'd rather garnish any bank account they can give the particulars of to the Sheriff to or garnish wages if the person isn't self employed.

Remember that they have to take you to Small Claims Court first, and you could probably get low payment terms from the judge if they did. And, if not, you could make a subsequent motion if they were too high or difficult for your circumstances.The main thing is: DO NOT RUN

The amount is 4K. I would almost sooner claim bankruptcy than allow them to seize anything.

Two more questions.

Can I demand that the do not record my conversations?

The other being, if I sign over my vehicle and tools to my wife or my friend, can they still seize them?

Make no mistake, TCR will take people to court and CTC will authorize legal action if the amount is significant - whether or not the debtor can pay for the aforementioned reasons. Read the early Deanna Natale blogs if any doubt remains in your mind.

Thanks for the replies. I do intend to pay this off, I just want to be informed. Dealing with these guys is like beating my head against a wall, they don't get anything you say, all they say back is they want full payment right now.

I will check into debt settlement companies, and I will also check back with CTC to see if this can be settled with them and if TCR can be given the boot.
