Statute of Limitations

Isn't there an act that directly deals with Limitations... called the Limitations Act?! :) That should make it law.

I should do some research and do an FAQ on the statute of limitations for each province.

Intriguing. Here in Alberta, they don't give legal advice, but SOL information they don't seem to consider "legal" advice.

Hey all!!

Angella: Just called the Ontario Court House about the SOL for a creditor suing for unsecured debt, and was told that I was asking a 'question that required legal advice' and that I needed to speak to a lawyer. Hmmm...Did I call the wrong number?

OK... just ask them to prove it without saying you'll consider it. Say you don't believe the debt is yours, don't recognize it, don't remember it, so send the proof and you'll check your records.

Enforceable means past the statute of limitations. Call the courthouse and ask how long the creditor has to sue for a debt that was incurred on whatever date you believe it was incurred. Ontario has changed recently to two years, but yours went defunct before that came into effect and I'm not sure what the old statute of limitations was. If they can't sue, they can't enforce the debt.

If they can prove the existence of the debt they can call you for it, they just can't do anything to force you to pay it.

Thanks...just one more question please. What if they can prove it (it's a cheque over draft). I think I know what it's from; a cheque deposited by a guy who sold us merchandise and we contacted him to return the merchandise. While we were waiting for him to pick it up and return the post dated cheque...he cashed it...thus the bank overdraft. I think that could be it, because we never heard from him, he never came for his stuff either.

What exactly is the definition of enforceable?
If I tell them to prove it and I'll pay aren't I making a verbal contract to pay and possibly make the SOL irrelevent?

Tell them to prove the debt is a) yours and b) enforceable and then you'll consider it. Until that time they are not to contact you in any way shape or form.

Then hang up, because they will probably begin to yell and there's no reason why you need to listen.

If they call back, inform them you have a phone recorder and this is harassment, then hang up. Again, do not listen to them.
