Hi there,

I have a very similar situation as the previous poster.

Back in 2008 I was still enrolled in and attending school when my student loans came due. I missed around 6 payments before the national student loan center sent it to CRA collection. I spoke with someone from CRA who told me that they wanted it paid in full, when I explained the situation, being that I was not currently working but my significant other was and asked about making arrangements. We had settled for payments of $300 a month, which is quite a bit on a one persons salary while they are trying to pay their own student loans, and the rest of the monthly bills. I have since been religiously paying the $300 a month by postdated cheques (6 at once).

When I filed my return for 2010, it was noted by my tax preparer that I was suppose to get back close to $3400. Great! That was going to pay for my wedding this summer. However, CRA assessed my return at $3500 and then took it all to pay one of my student loans. That would be great if we didn't already owe that money to people as I would love to have that $300 payment a month completely removed.

Is there anything I can do?

Hi Footloose.....

Overwhelming questions....but it appears as though revenue canada is the one holding back the income tax return. I'll have to get back to you on the other answers!

Thsi book is a must read for every Canadian tax payer

I Just finished reading an incredible book called the tax collectors bible...written by a former tax collector, who worked for CRA for 8 years.
It exposes all of CRA's dirty tricks, how they break all sorts of laws and shows you how to beat them at their own game..you will never fear the CRA again. the book contains over 400 pages of never before published information that every Canadian taxpayer needs to know. The information was so incredible I feel compelled to share it with everyone.

Need some clarification to your post.

1. When was this student loan received?
2. Who gave you this student loan?
3. How much was this student loan?
4. How much was the Federal portion? the Provincial portion?
5. When did you start paying on the loan, if ever?
6. When did you default on this loan?
7. When and with whom did you enter into a repayment agreement?

What do you mean when you say "Is there any avenues to take through which I may ask them to remove this lien or at the very least request partial taxes returned?" Who is "them" and what "lien"
are you referring to? Please supply as much details as you can before I can address your situation.

Hello,

I am not certain if I am submitting this question into the appropriate place so I will just forge ahead and keep my fingers crossed.

I have defaulted on my Canadian student loan but just recently entered into a repayment agreement. I have made five payments of 300.00 within the past 2.1 months. Is there any avenues to take through which I may ask them to remove this lien or at the very least request partial taxes returned?
