I feel you played the right hand by not paying out a dime until a written & signed agreement was received. Had you done so, those funds would have been applied towards the full balance of the debt - assuming your payment was made through some traceable method.
Infuriating one C/A at a time..

Who broke the deal?

Postby MakeThemBeautiful » Tue Feb 22, 2011 07:05:55 AM

I had an agreement with a collection agency where he would send me out a letter stating that debt was paid in full and to update my report within 30 business days. Well, he said he sent out a letter in the mail and that was almost 3 weeks ago. The deal was I was going to have it paid today. But since I didn't get a letter, I didn't. Now I did call him 3 times before the date I was supposed to pay and told him I didn't receive anything. He then said he would get his supervisor to send me the written agreement through email and a fax through staples. I never received anything through that either.

Anyway, no payment was made. So who broke the deal, me or them? I don't want to pay a dime without a written agreement. ALSO, he told me that now because I waited 3 months, I have to pay the debt in full, which I cant afford, but I took him at his word.

Please advise. Thanks.
