Thanks average_joe for clarifying this matter. When I first responded to

pissed at RBC, the whole thing made no sense to me. Now, I see what's happening and I'm glad that you alerted Monty Loree to the problem. Now, I can continue the discussion. Your input is much appreciated.

I believe what they mean is when they signed on the site there was no P.E.I.I sent Monty a message and he made the changes for people from P.E.I.

I am still very much confused by your answers. I asked the very simple question: "Where is the property located.............P.E.I. or N.S.?" Your response was: "PEI is not an option in the province to pick where you live." What the heck does this mean?

You also state in your response "The agreement with RBC was to pay the taxes on both property numbers". Do you have a written signed agreement with RBC and signed by both you and an official representative of RBC stating very clearly that RBC is responsible and liable to pay the annual property taxes on either or both property numbers? If the answer is NO, then there is no agreement. If the answer is YES, please reproduce the agreement in its entirety on this website for my examination. In law, all agreements involving real property MUST be in writing. An oral or verbal agreement is NOT VALID.

1. PEI is not an option in the province to pick where you live. :(

2. A moblie home located on land I own, ie: a mini home as it is called here

3.A mobile or mini home is considered movable here, although it is tied down it does not have a foundation.

4. The agreement with RBC was to pay the taxes on both property numbers. Here in PEI when you own a mini home, it is taxed as is the land. Thus two property tax numbers. Thus a chattel mortgage.

My tax portion of the payment went from $66 to $377, as they are trying to collect the money in three years as opposed to the almost 5 it took for them to find the error.

Your story seems very convoluted and parts of it doesn't make any sense. I need further clarification of the following points:

1. You claim that you obtained this mortgage in 2004 in P.E.I., but your blog shows that your province of residence is in N.S. Where is this property located...........in P.E.I. or N.S.? Please explain the discrepancy.

2. What is a mini home? Is this a mobile home located on a vacant lot?

3. You stated in your blog that you obtained a chattel mortgage. A chattel mortgage only covers personal ( moveable ) property. It does NOT cover real ( immoveable ) property, i.e. land. A mobile home, in law, is considered personal property, even if it is permanently fixed to the land. I have never seen, nor have I ever heard of a chattel mortgage which includes property taxes. Because a chattel mortgage only applies to personal ( moveable ) property, why would a chattel mortgage include property taxes that apply to real ( immoveable ) property? I strongly suggest that you thoroughly review in detail the chattel mortgage that you signed in 2004. I would venture to say that I would be stunned if you found a provision in the chattel mortgage that clearly states that your monthly payment includes principal, interest AND taxes. It may have been your understanding, be it right or wrong, that the monthly payment to RBC included taxes, but unless it so specifically states and details how it is to be calculated, there is no agreement as to the payment of property taxes vis-a-vis the chattel mortgage.

4. You further state in your blog "that the Royal Bank more than doubled my payments as the taxes for a portion of the property were not paid for four years". What do you mean "for a portion of the property"? Taxes are not levied for a portion of a property. They are levied for the entire property. This statement makes no sense.

If you can respond with your answers to clarify the points that I have raised, please revisit this site with your answers. Once I have received your response, I will proceed further.

Hi all and thank you for allowing me to vent. In 2004 I obtained a mortgage at RBC, (on PEI), for a mini home (chattel mortgage) and land. The mortgage was set up to pay the taxes included with my payments.

In 2008 when I made a payment and further checked my account it was NSF. When I called they told me that the Royal Bank more than doubled my payments as the taxes for a portion of the property were not paid for four years. I argued to no avail.

I have been in the process with them now for two plus years and they still will not admit they made a mistake on my mortgage. I wonder why they have mortgage specialists, loans officers and quality control at the RBC, if something like this can go unnoticed for four years.

In addition, since they found out about this error, they haven't been adjusting the account to pay the correct taxes, so now it is a huge payment.

I have offered them solutions to avoid bankruptcy and they have refused all of these. Now they have admitted to an error totalling $400 for overdraft charges and that is it.

Now to top it off, they have froze my account. Monies that were due on a payment last week have not come out, and monies that are due for payments the first of the month will now bounce.

The royal bank is holding me HOSTAGE. I am so sick of them and have been a loyal customer of theirs for the past 25 years.
