Do what I did when a CA kept phoning me about a stats barred loan. Send them a registered letter (keep a copy) telling them that you do not agree with their claim and you would like for them to take the matter to court for resolution. Once you say you want the courts to resolve the issue they are not allowed to contact you anymore. Don't worry, if your account is stats barred you will not hear from them again ..... I didn't.

How do we have them stop calling? They know I'm not going to pay... Its past SOL. Each time I tell them to send paperwork about what they claim.. they dont seem to comply... Very annoying

Don't worry, the thing is long past the SOL. But you should ALWAYS want creditors to know where you live, and even your phone number, whether a debt is stats barred or not. That way you know what they are up to and are available to defend any action launched. Even if they filed a claim and were successful, you could get it reversed on motion based on an S.O.L. defence. But none of that is going to happen for a whole slew of reasons too lengthy to go into in your case.

It's Christmas, and even Vikings celebrate the holiday season. Be Santa Claus and offer them 3% so the Christmas stockings of AK's Bob Cratchits' Tiny Tims won't be empty. Collection agents have hearts too you know (sputter...choke..gasp...wheez).

I want to know if not confirming adress to CA will increase chance of default judgement?
I got a call of a supposed CA asking if I am "John Smith" ans asking to confirm personal infos. I didnt give any info and after a while the agent finally saying its for a loan I supposedly had with a bank, in 1999, it been sale to "Aktiv Kapital" and they collecting it for them. After saying I dont know any of these and btw 1999 its long pass the SOL in QC, he transfered me to a supervisor. The supervisor asked the same things, not willing to send any doc to me for verification, saying he need my adress to confirm if I'm the right person. After all the time on the phone hes not even sure if I'm the right debtor!? Finally, he said he cant do nothing and will stop it here. End of the call...
What I'm worrying, even if its past SOL, the creditor will get a default judgement without sending me a court order. Arguing they dont have my adress... Is it possible? The CA said its for something with interest about 3k$...
