I need some help or advice.
I received a payday loan from Mogo Money in Surrey BC and everything was fine until last month. When my payment came back as NSF so I was contacted by a rep at there head office. I told them my situation about how my hours had gone down due to personal issues and I am a single mother and asked if I could do a payment plan until the debt was paid off.
She basically told me that I had till October 30th to repay the loan in full or it would go to there legal department. I asked her what that meant she told me that they are 1st party so they can pretty much do whatever including a 'wage garnishment" I pleaded my case but she didn't seem to care at all.
When I went on the BCPCA websit it said that Payday loan companies
B.C.’s Business Practices and Consumer Protection (Payday Loans) Amendment Act and the Payday Loans regulation prohibit lenders, including phone and Internet lenders, from:
· Requesting an assignment of wages, or collecting from a borrower’s employer.
So I guess my question is can they garnish my wages in BC as it would be devastating to me. Or is there something I could do to stop it from happening.
