Thanks Footloose and others,

In a funny twist the dispute was won and the item was removed. However a month later it appeared again but only under a different name with changed details. I have learned it was transfered to recover corp and recalculated. Is this legal?

Best Regards

I would tend to disagree, send multiple letters.

I have disputed many items on my file with success, generally on the 3rd dispute letter.

My guess is that equifax never actually validated the debt. Once they do it will be removed.

FYI....recently I've disputed a "cash money" collection that also was not mine. Took 2 letters.

Equifax is absolutely correct in their response to you. Equifax does not need proof that this debt exits. When they conduct an investigation of your complaint, they contact the creditor or collection agency to verify that the debt exists. If the creditor or collection agency confirms the debt exists, that concludes their investigation. Writing another letter to Equifax is a colossal waste of time. It will go nowhere.

See my blog on the Forum ---- Canadian Credit Repair ---- Correcting Credit Report Errors ---- Virtually Impossible

This will give you some background on what goes on behind the scene.

Good Luck and have a GREAT DAY

Cash Money DCA Burden of proof

Postby frustrated1 » Thu Aug 12, 2010 05:55:10 PM

I have one R9 on my credit report from DCA that I have disputed with EQF and TU. I just reciebved a notice that TU has removed the file because the lender failed to provide proof within the specified time. I attempted to dispute it with EQF stating I needed proof. I was told they dont need proof I have to chase the collection agency instead?

Is this correct and if so how should I phrase my letter to EQF to try again?

Thanks all and Monty and keep up the great work!!!
