I wasn't suggesting you sue anyone.That would be absurd. I was ribbing another crazy guy on the forum who thinks you can sue the FBI, the Pope and the Queen. Sorry for the private joke that you would have had no way of knowing about.

Thanks for the suggestions. I cannot see me being able to sue them with all these doctor's appointments and tests I have to do for my baby - nor having the emotional capacity to deal with it on top of speech therapy and the assessments my son has to have done as well. Plus I live in the middle of no where - more than 40 minutes away from any lawyers or legal aid services and I don't have access to a car - I have to schedule appointments around the one afternoon and one morning a week my mom has available to drive me places.. My situation is pretty crappy right now but at least I'm away from the violence and am safe with my baby and son.

Should you record the calls and sue be aware that at the Discovery phase of the process you would be require to give them a certified copy of the tape or a certified transcription of the conversation.
It is much better to present the tape in court as it shows the tone, etc used by the caller.

Along with Hankety's advise I would suggest you record these phone calls as you can then have evidence of the abusive nature of their calls should you decide to reverse the tables and sue them.
It is perfectly legal in Canada under Federal law to record the call....but do not tell them you are.
As long as one party to the conversation has consented and that is you it is legal and admissible in court.

Quite a mess. NCO has to obey Ontario collection laws, now that they are trying to collect in Ontario. Therefore if you send them a registered letter demanding they only contact you by mail in the future, they have to comply. Anyhow, you really can't expect anything more from a bunch of Ex-Somali pirates. They're trained in telephone terrorism and have few other skills.

Ontario Works, disability payments etc. are supposed to be exempt from garnishment and seizure. If you, or possibly your dependents, have chronic medical problems, you might be eligible for medical loan forgiveness, I know people who have applied for and gotten it, but eligibility rules constantly change. No sure what you might qualify for.

Also, if you haven't already, you should open up a bank account at a different bank than the one you're been dealing with. Not just a different branch of the same bank either. It's unclear why you don't get direct deposit. I also don't know if the form you fill out to get Ontario Works direct deposit will be shared with other government agencies To get OSAP and OW, you generally have to sign away all your privacy rights including access to you income tax return.

It might even prove wise to open up 2 accounts at different banks. Remove wages and OW deposits as soon as they're deposited into the first and transfer them to the second to protect them from potential seizure. Don't write any checks on the second account either. Even if certain income is supposed to be exempt from seizure, possession is often 90% of the law; trying to get money back can be timely and difficult.

I am 5 months pregnant with a high risk pregnancy and I have a 2 year old son and recently escaped an abusive situation.

I called NCO to update my information and to get a statement of my account as for the past 10 years my income tax refunds have been taken to pay off my OSAP and I wanted to know how much was remaiing 1700ish.

I filled out their statement of account and explained that with my high risk pregnancy, single mother with a 2 year old son and medically unable to work due to my pregnancy high risk status my financial situation will not change.

They are still calling me every 2 weeks constantly and they are REALLY rude to me. I tell them I cannot make a payment arrangement at this time as I am in receipt of Ontario Works and they tell me if I can afford to pay my student loan with ti I don't need that part of the money. Yet they get snotty with me and hang up and yet keep calling and calling and calling.

It is stressing me out big time - when I am already in a massively stressful situation with my baby being high risk for having downs syndrome and dealing with a son who may have a possible autism diagnosis, and just escaping an abusive situation, being 32 years old and pregnant and all alone :( I do not need these people making me feel worse than I already do and I was the one who made contact with them and I filled out their forms and cooperated and havee been fully honest about my siutaiton but they just keep calling! Is there a way to request them to stop calling me every 2 weeks 3/4 times a day (I stopped answering them because they are truly nasty to me and the last lady yelled at me and then hung up when I was calmly explaining I was pregnant, highrisk and a recipient of Ontario Works.)
