Hi,
I had a student loan opened in 1995, I made my payments regularly until 2001 when things went downhill. New baby + marital split = bankruptcy.
My last regular payment was June 2001- when I filed bankruptcy. I never once since then heard from the bank or any collection agencies. The govt took their portion out of my taxes in 2004 and paid off their guaranteed portion. I am told by the bank that it went to collections first in 2004.
6 weeks ago I started getting phone calls, the first time I answered I was advised they were collecting on debt from RBC student loans. I advised them that I owed no debt and have not spoken to them since.
Today I spoke to my bank to find out details on their end such as the last payment amount/date and balance- since I had thought I had paid it off with my taxes...they cant confirm this as the debt would have been sold by them. They dont suggest I pay it.
Am I safe to ignore this? I was hoping to buy a house next year and I have just spent the past year or two rebuilding my credit and my life. I don't want them to be able to repost this on my credit history and ruin things for me.
What is the statute of limitations in New brunswick? What constitutes "acknowledging" the debt? Did I screw myself over by talking to the bank even though I have not talked to the collections agency?
