Collecting debt from US in Canada. Any advice?

Postby nomoneynofunny » Thu Apr 08, 2010 10:27:59 AM

Hi,
I'll try and make this brief. I am a US/Canadian citizen and worked in the US (Michigan) for about 5 years but still lived in Ontario. I accumulated $55K in US credit card debt and have been unable to pay since my husband lost his job last year. I tried to pay minimums but that just depleted my savings and no way to get ahead. Now the savings has run out and I'm at least 120 days late and the collection agencies from the US are calling.

I still live in Ontario and haven't worked in the US for at least 5 years but the credit card companies only have my US information. I am trying to make a settlement offer but if they decline what then? Will they try and sue me in Michigan or in Ontario (if they can find me, which shouldn't be too hard). Should I explain I dont live in the US possibly giving them more incentive to settle? I don't want to show my hand too early because then the harrassment will start at home too, not just on my cell phone. I still hold a mailing address in Michigan so all correspondence goes there.

Any help appreciated. I looked into bankruptcy but no one seemed to know what would happen to the US debt.

Thanks!
