C-C... Once again I'll state that I'm not the one nailing the SPAM button either, so it must be someone else who isn't fond of your banter.

With respect to folks avoiding the truth, once again your views on truth differ from how the legal bodies have viewed it to date. In addition, the fact that it took until you paid off half of your loan doesn't help your case. If the banks manipulated the credit application(s) as you state, then that's something you should have picked up on (and dealt with) day one. It would appear that anyone reviewing your story can see this (whether you like it or not).

TD loaned you money that you gladly accepted and which made you a beneficiary, NOT an injured party.

You can only sue for an injury. You can't sue someone for lending you money as long as they correctly put in writing the (legal) terms of the loan - which TD did

The judge was just about to get the court officer to toss you in the clink for contempt after you kept arguing with him when he rendered his judgment. He also could have easily awarded TD $10,000 in court costs, instead of $2100. I would have. The next judge likely will award the full amount after your case is dismissed as worthless in November. Your wife will be on the hook for that too, won't she? Does she have any comprehension of what she's getting into?

Since you are fond of legal terms, Judge Wheatley repeated that you and your wife are jointly and severally liable for the judgement which is accumulating post-judgment interest of over $3000 a year. That means if you don't pay, she is on the hook. That's why she might have to declare bankruptcy a second time - and you with her.

TD made you a very generous offer that they'll forget the whole thing if you do; but, like Captain Ahab, you want to go down with the ship. So be it.

Yes, he tried to circumvent every nook and cranny of the legal system and completely failed. He spent more work doing so with his Captain Ahab antics than if he had actually worked for minimum wage to pay off the car. But he blames everyone in the universe, except himself, for his misfortune. He'll probably die that way. Hopefully, he won't take anyone down with him.

Hank, I figure TD is going to squeeze Amanda and Steve pretty tight after they rejected their recent offer and posted the terms online. Surely TD is aware that he's essentially told them to go 'crash their kite' by doing this. Oh well, we can see from day 1 they've been trying to renege on the contract they had signed with VFC. If there's a different owner on this vehicle now, that goes to support this theory, too - especially if he's still allowed to use it as if it was his in title.

Postby avonannie » Sun Jun 16, 2013 07:41:10 PM

I have a judgement from a company on my credit file that was clearly settled in the consumer proposal, but olgivie bought the file from presidents choice after the proposal was accepted, and now they have it listed as a judgement, how do I get it taken off, the person who files my proposal is no longer around thanks
