The next question that you could check with Consumer Protection is :

Who gives the government authority to use a collection agency. Where is it legislated that an individual would have to deal with a third party collection with regards to a traffic violation, ticket etc?

This is really the most important question.

You may have to write to Consumer Protection if they don't have a quick and easy answer. I'm sure this is not a standard question that they get asked each day :)

Here is the reply I got from City of Toronto Court Services (this is not a parking ticket - it's a traffic violation):

In response to your inquiry, please be advised that there is no limitation period with regard to the collection of outstanding fines.

That's a really good question...

It's my opinion that the government can't use collection agencies to collect traffic tickets because there is no legislation allowing them to do that. Also, the consumer doesn't have an agreement in place with collection agency.

Can you call your local Consumer Protection - Provincial Justice department and ask them for the law that talks about Statutes of Limitations for traffic tickets, and also where the law says that the government can use collection agencies for parking tickets.

Most statutes of limitations for debts etc is 6 years.

This agency phoned my home three times yesterday. They've been calling for years over a traffic ticket issued to my husband when he was riding a bicycle and the officer felt he didn't stop properly at a stop sign. This ticket was issued in October of 1995!! Is there a Statute of LImitations on this?
